New Bankruptcy Bill Moves One Step Closer

This week the House Judiciary Committee’s Subcommittee on Commercial and Administrative Law passed HR 3609, party-line vote of 5-4. This new legislation would allow bankruptcy judges to modify the terms of a mortgage contract during bankruptcy proceedings. The sponsors of the bill claim that it would help up to 600,000 people from losing their homes, but they are getting strong opposition from opponents who claim that the legislation as written would drive interest rates up for everyone seeking a home loan.

My feelings are that if these lenders and servicers would only comply with the requests by several government agencies and the recent plea by FDIC Chairman, Sheila Bair, to work with borrowers more proactively then this bill wouldn’t be necessary.

It’s clear that government is getting sick and tired of asking lenders nicely and now they will be forced to with this new bankruptcy bill.

According to their press release, Rep. Brad Miller (D-NC) and Rep. Linda Sánchez (D-CA) who introduced the bill said the legislation “will treat home mortgages the same as mortgages on investment properties and family farms. The bill repeals a provision that prohibits a bankruptcy court from modifying a home mortgage, but allows a bankruptcy court to modify any other secured debt, including mortgages on other properties.”

I feel lenders and servicers who have not stepped up their loss mitigation efforts with their borrowers are only driving the last nail in their coffin. Their hard ball tactics with delinquent borrowers are going to bite them is the ass.

This bill will be of great benefit for homeowners and I believe they need it, but it will have a significant affect on our bankruptcy courts by inundating them with hundreds of thousands of filings. How in the hell are they going to accommodate that many people?

Kurt Pfotenhauer, Senior Vice President for Government Affairs and Public Policy for Mortgage Bankers Association (MBA), said “The current legislation gives no guidance as to the proper parameters for judges to modify existing loan contracts.”

My solution to this is for lenders and servicers to disclose and create “Underwriting, Policy and Guidelines” in regards to how loan modifications are approved, who is eligible and make this available to the public. Their hard ball stance and secrets in regards to modifying loans is a poor business move and if they do not get their acts together, then this new bill will force them to.

    you know i am having the same results with countrywide the thing is is that I’ve been doing it since march and i am still not able to get a modification , and I was sent a foreclosure notice already, I ti’ll december to pay or i’ll be foreclosed it is all a farseby countrywide, i am tired of this and i am going to get a lawyer and find out if i can sue them or take somekind of legal action because this is a ripoff, busting my as from check to check to pay for this house and know i can’t afford the payment because they went up 950 dollras and every 6 months after that it’s going to go up and up what a scam this is i am really pissed off at these loan banks they are worse then a terrorist

    The troubled consumer home loan restructuring process has to have some way to accomodate the poor credit health of most of the folks in default on their ARMs. We should create these adaptive underwriting standards.

    can someone tell me the steps i need to start with to get on the ball and make sure im on the right track on dealing with countrywide, We are trying to get a mortgage adjustment or modification what stepd do i need to take to get it started and what should countrywide be doing when that time comes, we pay 1490 on first and 581 on 2nd and it just increased due to property and home owners on the 1st loan went up 400 more and thats 1800 on 1st and 2nd 658 theres no way where al ready behind september and its hard to recover when u get to deep in debt.. But if someone can tell me what i must do on my part to get this going would be wonderful thank you

    The first thing you need to do is call Countrywide and start the long are difficult process. Document everything you do, say and hear. Hope for the best and expect the worst because Countrywide does not have a great rep for helping people.

    what do u mean buy convincing the lender its in there best interest? and we only have been in the house for year and we had i guess a no doc loan? and we are upside down. 1st loan is 1449 and 2nd loan 568.32 and then sept it went to 1854.68 and than it has a negative of 670.67 for escrow shortage and than october is 17111 theres no way and our 2nd went to 68?.i dnt want to loose my house, but this is insane and of course guess who its threw ! coutrywide. help me i have no idea!

    It was never your home to begin with… you didn’t have hardly any equity in it. If you did you could refi or you wouldn’t have a mortgage at all. Your “reality” isn’t reality. You don’t think it’s fair, but how about the people that loaned you money that you’re not repaying??? You might not like the terms of the loan, but you signed for them and agreed to them. Didn’t read the fine print…? Well chalk that up to a lesson in contracts. Next time you’ll do the due diligence before making such a large “investment”.

    I try and be positive when I can but I am also a realist and I have to let you know that it will be very tough to get this to work. If you cannot prove income on a loan workout, then they will not even work with you. Especially Countrywide. I see people who can prove income and still cannot be worked with.

    I know you do not want to lose your home, no one does. But please make up a back up plan. Hope for the best but DEFINITELY prepare for the worst.

    The people that lended the money are SHARKS. LOAN SHARKS. The only difference is that cannot break knees, they just take houses, which is actually worse.

    These people (investors) need to wake their little asses up and smell the crap because they may know contracts but they do not know the mortgage, real estate and loss mitigation business. They can take their little MBA’s and big mumbo jumbo contract talk and stick it where the sun don’t shine because soon, that’s where their heads will be.

    Their assets will be worthless if they don’t modify these mortgages, so you should let your investor buddies know. Do you know what servicers are doing with your money? I bet not.
     
    Maybe you all can share a cheap bottle of scotch on your dirty linoleum floor and then roll around in your misery when you don’t get your Christmas bonus and your 750 Beemer gets repo’d and then your wife leaves you for Moe because you lost your job at Lehman Brothers after the stock market tanks.

    Hell, the law firm I work with is hiring. Call me when you lose your job and I’ll see what I can do. We need someone who is good at reading this fugged up contracts.

    countrywide just told me either put house up on market or short sell it or borrow liquatad or ask my local church for help. u got to b joking! id rather forclose screw my credit up and let them eat the loss. we have nothing in to it besides the bathroom remodel that i will take with me if i have to, if i leave this house, what a joke they are 4 times hung up on and than that women was a big *(*_ and i see what i have to look ward to , thank u for help

    thanks, but i guess u have to have to make a certain amount so ur in the positve and i guess where in the negative to even get approved and i guess countrywide bought mortgage lenders in January, so they said that they wont even consider it for review. but we bought our house in july of o6 and they are only showing January of 07 when they bought the loan from them, so how does that work? i cant understand any of this and basically talking to the lady on the phone after 4times disconnected and she tells me that ask our church for the funds, and i said that we are upside down plus not worth what was bought for a year ago, and 2 of the ladies i spoke with where rude and ask what was damaged on the house? i told her nothing, but told her that if we cant be qualified for the modification than we will loose our home, the people across from us home has been up for a year and they did a lot of up grades and my friend in the reality bus. said short sales are even hard to sell homes too. and they dnt care if you forclose. i told the lady if ths modification doesn’t happen we will have to forclose and so b it if the credit is hit, also they said we had to be at least 3months behind in payment. and we are only one b4 we tried to get something going and work out this b4 its to far in the hole! countrywide are jay john crap like that schmuck! im lost with all this and what to do?

    Yes, your in a tough spot and most likely will lose your home. It sucks and it shouldn’t be this way. Just prepare for that NOW and get all your ducks in a row, so you have shelter when that day comes.

    This maybe a suggesstion, find an attorney that will file a class action lawsuit against Countrywide for preditory lending, because that is what they did, and the general public(homeowners) is now being made the victims of thier scheme. I once advised a gal I was working with on a loan modification about two years ago to sue Countrywide for not agreeing to do the modification. The reason being was that her husband was in active military duty. There is currently on the books of the US federal law stateing that you cannot foreclose on active military personel, it’s called the “soldiers and sailors act of 1942″ or more currently called the “civil relief act of 1982″ you can google it and read up on it more. but this gal won her claim and they had to bring this house out of foreclosure, and work with her to modify the loan. Countrywide may be the biggest lenders out there but that does not mean they cannot obey the law.

    Great info and advice. I really appreciate that. I am very aware of that act and many homeowners lost homes when they could have used that as a defense.

    I agree with the lawsuit. But we need homeowners who are victims to let their voices be heard and stand up for their rights. We need to fight back and we need to unite. As one we are weak, as an army WE WILL CONQUER!

    Hi Moe,
    I am about to make my last forbearance payment with Countrywide. My income was dropped by $10,000 and could not afford to make the payments. I called the company immediately and was told that the loan had to be at least 4 months behind before it could offer me an kind of help. I did ask if I could make 1/2 payments or interest only payments and was told they could not accept anything less than the whole payment. I took a hardship loan against my Thrift Savings Account and caught up on the payments. Then I went right back into the same boat. I called right away and received the same message. So, I waited the 4 months and then contacted them again. They had 3 or 4 different programs out there to help people in my situation but; guess what? I didn’t qualify for any of them!! The lady I spoke to was very condenscending and I argued and pleaded with her for over an hour to help me. I did not want to lose my home!! Eventually I hung up in tears and called my daughter. She is sort of like a bulldog when it comes to unfair practices. So, the next day we put a 3-way call into Countrywide and ended up speaking to the same lady. She took on that same condescending whine. My daughter immediately interrupted her and asked to speak with someone else. She said ok; but we would have to call back because she could not transfer us. My daughter immediately asked to speak to her supervisor and we were put through. The supervisor walked us through a new workout sheet on all my household expenses and agreed to help me. It has been a very tight squeeze but; I am now about to prevail !! I am now in the process of refinacing my mortgage with another company in order to get out from Countrywide. I am going to a fixed rate. I am not happy about having to tack on another $9000 dollars to what I already owe; but at least my payments will be lower. People..Don’t let anyone tell you that you cannot make 1/2 payments. This is not true. A man from their Customer Service Department called me and asked if I was satisfied with their company. I said no and told him why. He then proceeded to tell me you can make 1/2 payments but; their employees are instructed not to tell you this. I would suggest sending a money order or cashier’s check. This way you know they would have to accept it. If I had known this earlier on; I wouldn’t gotten so far behind. I am appalled with a company that is so unwilling to work with a person in order to keep their home and is trying to make good on their debt. I have 16 years to retire. How am I supposed to be able to keep up these payments after retirement or how much equity am I going to accrue in order to sell it at the approiate time when I keep having to refinance my home? I cannot afford a 15 year loan. Any suggestions? I hope by telling of my experience; I can help someone else that is in the same type of situation. I bet my credit would not be good enough for them now anyway. lol

    I think this is all just Countrywide propaganda. They have their earnings report coming out Friday and all of a sudden they come out with this press release. Rubbish. BS! Well said. He is a reflection of the company and what they stand for. Too many people are losing their homes to the predators at Countrywide and until I see actual evidence that they are in fact helping people that deserved to be helped, I will continue to expose their lies.

    Here is a follow up from my borrower who I am assisting in getting their loan modified with Countrywide. They are at a point where I am out of the loop so they are keeping me appraised of the situation-

    I thought I should let you know whets been going on so far not that there’s been much to tell. In essence we’re still waiting while they bleed us dry. I faxed in 29 pages of info on the 11/2 and was told that is takes at least 48 hours to receive the faxes in. I was finally told that they received them on the 7th. As of yesterday we still haven’t been assigned a negotiator. I was told this could take 7-10 days. When I told them that I would like to expedite it so that I wasn’t late with my November payment I was told that once the modification was done that I wouldn’t have to worry about the late payment. Fortunately I called back again in a couple of days to check status and instead of transferring me to the workout department I was transferred to collections. I was told that I did still have to make my (inflated) payment or there would be late fees. The reason I had been waiting was on a previous call when I went through my budget and was told to fax in my info, I was told that when the modification went through that I would still need to make another inflated payment “in good faith”. So while they are sucking me dry and taking their time I will also have to make my property tax payment by 12/10. Yesterday I was told hat the modification could take a month or more.

    Sorry about the rambling but as you can imagine we’re starting to get a little stressed out… Every time I call I get more or different information and really seems as though they are dragging it out. Also I’ve been reading some of the message boards with former employees of Countrywide telling of their practices. It’s a little distressing. Hopefully it will work out in the end if we can just survive it.

    I’ve spent the last couple of hours reading through this website. My heart goes out to the people who are struggling to keep their homes.

    There is a sick shock that comes over you when you realize that somenoe has swindled you with something as important as your home. I know, I felt it when I looked at my own loan documents.

    Moe, I want to say you’re doing a phenomal job of informing the public.

    To my great dissappointment, I have a Countrywide loan and it’s negatively amortizing at an alarming rate. $12,000 in 10 months!

    So I want to have it modified but I am looking into how best to do this.

    I have the misfortune (or fortune) of living minutes away from a Countrywide Financial Center. If I walked in there, would I have better chance of getting things done?

    Also, I have discovered documents in my loan document packets that I SHOULD NOT HAVE — these probably should have gone to the Title processor and it discloses that my brokers got a YSP of over $14,000! Yep, and all undisclosed (HUD statement states $3,000. Of course, there’s a huge prepayment penalty that I knew nothing about.

    So what would you advise?

    Tracy, as a Countrywide borrower with plenty of experience with how they operate, tell your client to keep faxing those docs and even USPS them with a request for signature. She also needs to call and DEMAND the name of the supervisor of the department. Keep calling, keep bothering them. Don’t just leave it up to them because your file will get lost in the shuffle right now, and they will not call you back!! They have closed out my short sale twice and have now re-opened it because of my constant bagering!! YOU SET THE TERMS. Good luck, may we all save our homes.

    I have the same problem. I am working with freemont Investment Loan modification. I have gone through the phone calls and the faxes issue. I started this in the begining of the year 07 January to be exact. I tried to refi and couldn’t because I made to little they nedded another person on the loan my daughters live with me but there credit isn’t that good. I also have an autistic child. My daughters help me of course with the payment. I was fitting with them for about two months and had to stop. My father went in the hospital w/ cancer in march and passed in september the arm started in december they say it takes 6-8 weeks and I am still waiting for there phone call. They say they are waiting for the appraisal that they submitted on 12/19.

    I have called, they said they would call back, did not. I called and was disconnected. I tried to email and was rerouted with no way to email. I faxed and got no response. What government agency oversees this company. They are in the process of destroying me.

    If anyone tells you that Countrywide does short sales I can tell you that is a load of you know what. I have been trying to shortsale my house since November 07. I did not have on of these crazy sub prime loans. My husband got transferred and we had to move from Phoenix to San Antonio. I had a pre-approved buyer and a date to close. 1 hour before the closing the buyer backed out. I found out about this as we were driving to Texas. Unfortunately could not turn back so decided to sell. House sat on market for what was owed plus costs for 6 months. Eventually I told Countrywide that I could not get it sold and I coned anuld not pay the mortgage. THEY said to do a short sale. I sent everything that they wanted to that mystery fax number that everyone knows about. Everything that I sent clearly stated that this was a short sale request. I had an offer and I sent it and waited. 2 weeks went by and so I called. I was told that it would take anywhere from 4 to 16 weeks to get assigned a forebarence negotiator. I told them that I was asking for a short sale and was told rather rudely that that is the same department. After 2 months waiting my buyer walked and I called to tell Countrywide. They told me that I did not need a buyer because they might approve my forbarence. I just about pulled my hair out. I left a messege for a supervisor to call me back. (they never do) Anyway 3 days later I get a call from Tevy in India. She was calling with the happy news that my fax had been routed incorrectly and was in the wrong department. I should have been in the shortsale department. No kidding! Anyway we lowered the price more and did get another offer. K2 below the previous one. Resubmitted everything again to the magic fax number. Several call later I was assigned Julie. A rather rude woman who took delight in yelling at me down the phone that this takes time and I will just have to wait. That was on the rare occasion that I spoke to her. Mostly you just get that department general number and they cant help at all. 6 weeks later I have been informed that the file is with the “investors” for a decision. I was told by Julie that would take 2 to 4 days to get a response. That was 2 weeks ago. Today my buyer decided he could wait no longer and walked. I am now close to the foreclosure date and countrywide appears to want to foreclose on my house. So if they offer a shortsale option. Laugh really hard because I can tell you that they have no clue how to move at any rate of even snails pace, that don,t care what happens to you ro your house despite what they say. They lie about calling back. They just dont. They lie about how long things take and they can shove that fax number far up where the sun dont shine. They have “misplaced” my documents 8 times…and counting

My daughter has a morgage loan with Countrywide.They put the loan in her name because her credit was better than her spouse.She does not even work.At the time she signed the paper work she was in the hospital and had just had a baby and had medication.The man took it on hisself to go to the hospital to have her sign the final paperwork.She has four little girls under tyhe age of eight years old.They are behind in their mogage and countrywide will take their home.She has not had a joband will never e able to work because her baby was born with a very rare blood desease.The baby requires special care around the clock.Can anything be done about this.The family has been helping them pay the morgage but no sooner than you make a payment another one is due.The payment is very high.We can not keep helping out because we are living on a fixed income and are senior citizens now.They were wrong in putting the house in her name with no job and going to the hospital after she just had a baby and had alot of medication in her body.What can be done about this.Can anyone give advise on how to save this family from this disasder. Having their home took awaway and nowere to go.Ido not no who to contact to even talk to about the way this loan was done.

    I want a lawyer to do a class action lawsuit against Countrywide Home Loans for predatory lending asap. There’s got to be lawyers right now getting that ball rolling. What they did with their phony appraisals, lies, and they are the ones that completely ruined the housing market, and then sell our houses for pennies on the dollars to grave dancers to flip them when most of us have our life savings as down payments, and thousands more fixing the houses. They have caused what is turning into the worse depression since 1929, and what does Bush do, he bails out those who have caused nothing but misery for all of us regular people.

    I HAVE MY MORTGAGE W/COUNTRYWIDE AFTER THEY BOUGHT IN JANUARY. IN MAY MY PAYMENT WENT DOWN, I CALLED CW AND THE REP TOLD ME IT WAS AN ADJUSTMENT FROM THE PREVIOUS MORTGAGE CO. I STARTED A REFINANCE IN JANUARY W/COUNTRYWIDE. EVERYTHING WAS GOING O.K. THE % WAS LOCKED IN. THEN I RECEIVED A 2ND PROPERTY TAX BILL UNPAID. I CALLED SHERIFF’S OFFICE. THEY SAID YOUR MORTGAGE CO HAS NOT PAID THIS–IT WAS SUPPOSE TO BE PAID IN NOV. I CALLED COUNTRYWIDE AND THEY SAID IT MUST BE DUE TO REFINANCING. I DISAGREED BECAUSE THE BILL SHOULD HAVE BEEN PAID IN NOVEMBER. AFTER TALKING TO MANY PEOPLE AT COUNTRYWIDE–I FOUND OUT THEY TOOK OUT MY TAXES WHEN THE PAYMENT WENT DOWN. SO BASICALLY THIS HAS PUT ME ANEGATIVE ESCROW. AM AFTER I WAS SO UPSET AND TOLD THE COMPANY MY FEELINGS!!! THEY TOLD ME THE REFINANCE COULDN’T TAKE PLACE AT THIS TIME. THIS WAS ALREADY LOCKED IN–THEY HAD MY INFORMATION. I KNOW THE TWO ARE CONNECTED. I HAVE BEEN DOING A RUN AROUND W/COUNTRYWIDE EVER SENSE. I WROTE LETTERS, PHONE CALLS, DOCUMENTED EVERYTHING. STILL NOTHING. I WAS EVEN TOLD BY ONE OF THE TAX DEPT REP THAT THEY CALLED THE SHERIFF’S OFFICE IN KY. AND THE SHERIFF’S OFFICE OFFICE TOLD THEM NO TAXES WERE DUE.     Many companies use to offer a payment deferrment plan for those experiencing hardship. Is there any law that requires them to offer this. I have my loan with Chase Home Finance and have had a recent issue with escrow and home owners insurance. Long story short, after a refinance my home owners’ insurance was not paid by Chase. A year later Chase sent me a letter telling me I did not have insurance. I called my insurance company and after doing some in depth research and phone calling found out that A) the insurance company had not sent the bill to Chase or B) Chase had not paid the insurance company. Come to find out I did not have home insurance for about a years time. Chase has subsequently gone back and charged me for the year of insurance in arrears. Is this legal? I have sent a certified letter to Chase asking for a copy of the policy and a copy of the reciept of payment for the policy. This added amoung of money to my escrow account has cost me over $200 per month in my payments, which I am currently one month behind and have been for many months. I am trying to work something out with them. Really frustrating. Was glad to read all of the info on your site, very helpful.’=

    Do you have any information on the lawsuit that was filed against HomeComings Financial? I received something and believe I completed and returned the form to be included in this, and have heard that some folks received renumeration, so was wondering if you might know who to contact. Thanks.

    I am yet another disappointed customer of Countrywide. I have had to make some short payments in order to survive and now they won’t take them any more…they returned my check and then charged me a late fee! They also raised my monthly payment by 250.00 to cover the short payments, I can’t pay it!!! It will start adjusting in July and will probably go up again. I will probably lose my house; I am considering bankruptcy. I don’t know what else to do? Countrywide is NO HELP AT ALL. God Bless each of you going through this situation.

    Countrywide is the biggest ripoff company ever. I suggest you do as I have done get yourself a tape recorder and tape every conversation you have with them document who you talk to. They claim they are trying to help people in this foreclosure crisis but they only add fuel to the fire. I have several associates and supervisors lying to me on tape. Reasons why I got denied for a loan modification, my reasons went from i make to much to not enough to the months I’m behind. I am fed up with them and will try not only to start a class action lawsuit but to bring to everyones attention just how deceptive these lenders are. Join me lets band together and fight them and let them sit in the hot seat. Also note they kept telling me they were working on the re-modification for 4 1/2 months then 2 days before my 300 dollar increase I was conveniently denied. thanks Countrywide for nothing

    I would have thought after the Angelo Mozillo incident, they would have been more helpful, it seems the fat cat (A. Mozillo) is still sitting pretty in his overlytan self…

    He is a true thief ! he did ex- emplyees wrong (still oweing them months of commission checks), current employees are working their a$$ off, current borrowers are trying to make it, but with his policies etc, if you call one customer service dept. you go to India, if you call another # you are in some other place, file have been misplaced, WE need Loan Workouts / Modifications NOW, before we keep clogging the foreclosure courts and people are in the streets with their families.

    HELLOOOOOOO CountryWide wake up ! we need help NOW !

    FOR. IT WAS THE BANKS THAT ARTIFICALLY
    INFLATED VALUES, HOW WAS THE HOME OWNER
    TO TELL THAT THEY WERE FOOLING US.
    THESE PEOPLE WERE SUPPOSED TO KNOW WHAT THEY WERE DOING. WE TRUSTED THEM. IF
    THE GOP DOES SEE THAT THIER BLIND.
