Hi,

This morning I called in like I laways do to make my monthly mortgage payment and when i tried making my October payment through the automated service at asc the system said they cannot accept my payment over the phone and I was transferred. When I spoke with reps. telling her I wanted to make my payment she said she needs to transfer me to the loss mititgation dept and I asked why? She replied because my loan is being reviewed. Once transferred to the loss mitigation they wouldn’t accept my payment because my loan modification paperwork is being reviewed and they cannot accept payments till all is settled.

I refused to accept what they were saying to me and that I have every right to make my payment. Then I asked to speak with the supervisor , and As I spoke with him I told him . Give me a good reasaon why asc is not accpeting my payment? He said I need to wait for the loan modification to be accepted. I said that is not a good reason, If I took out a loan I need to make my payments and I also stated if asc will not accpet my payments then I have to speak with my lawyer. Then Asc will have to explain in court why they diidnt accept my payment and forcing me to be delinquent and ruining my credit. Thats when he said that he will be more than happy to accept my payment. I also mentioned that my second loan payment will be paid by October 12th and he noted that in the computer.

I also stated that I was going to call every single day to check on my loan modification because I applied last month and they told me it would take up to 45 days. And I also stated that When I applied for a modification I did it for both my interest and the lender’s interest and most of all I have taken action 6 month’s prior to my loan adjustment. This should show care and interest in my property and the well being of my family . If I diidn’t care I would be calling almost everyday.

We all need to be aware sometimes you end up being in a bad position due to ignorance and carelessness.

And a lot of people got fat from all that ice cream… while others got seriously ill from the lactose!

Good one. I think that’s what America is suffering from. A serious case of lactose intolerance.

I currenly work for a lender and can tell you that all lenders operate differently. If a lender ever refuses to accept a payment from you, your safest bet is to open an escrow account and put the paymet into that account. This will show the court that you had the money to make your payment – obviously it goes without saying to make sure to document all conversations with your lender showing you, in good faith, attempted to pay

Thats great advice! I really appreciate that.
