		<description>I have a property in Georgia [GA] for which I sent a Qualified Written Request [QWR] to Aurora. I asked for quite a bit of info. I sent it to them as I believed them to be my mortgage company. [ The company who bought the loan from AHMS]

I received a letter in return from Aurora&#039;s compliance analyst [attorney?]  stating that they are only the servicer. His reply was well outside the 20 day response time required by RESPA 6. I sent it to them Registered Return Receipt through a Notary Public. 

He further stated that as the current servicer, master servicer and/or sub-servicer of the loan they will enforce their rights to foreclose as my questions did not pertain to loan servicing.  GA&#039;s average foreclosure timeframe according to what I found on the Internet is only 37 days. I am 35 days late with the 10/01/2010 payment and 5 days late with the 11/01/2010 payment.

Additionally, he stated that the current owner is FNMA and the originator is AHM Mortgage and that the servicer did not have to provide me with any of the info I requested.   What I am looking for in my QWR is mainly info regarding the chain of title, securitization of the loan, who is holder in due course etc. 

Can I send a QWR or something similar to FNMA and AHMS or because the QWR refers only to the servier?

I lost another home of mine where BOA would not provide me with anything I requested while the Notice of Default was dated April 30, 2009 and for someone else&#039;s parcel number . I pointed out to the court that they have not proved they were in Holder in Due Course. As a result the attorney then provided the court with an assignment of Deed of Trust dated April 23, 2009, notarized May 11, 2009 with the incorrect parecel number again.

I tried to file a completed Lis Pendens and brought my filed court case as an attachment to the county recorder. He refused to file and told me to get a lawyer. I sated that he had to file it as it affects the status of the property. He then told me to leave or he would call security. The home was sold the next day with the lawsuit still pending. 

I was still fighting the foreclosure when the judged ruled in favor of BOA three months after the house was sold. [this was my personal residence]. The GA house is rental which is without a tenant because the prior tenant broke their lease and caused  $ 2000 in damages above and beyond the security deposit. I do not have the money to bring the house back to rentable condition. Therefore I cannot pay the mortgage.

I really screwed up. I am a 100% Disabled Vet without the ability to work. I took my life savings and IRA [ around $ 500,000 paying all closing costs, rehab costs, where necessary and 20% down on all but one property ] and bought 10 rental properties between 2004 and 2007. I figured the properties would increase in value, the renters would pay the mortgages and eventually we would be able to draw a monthly income from the properties. I tried to do things right. I have lost my shirt. I was not and probably should have been one of those people who bought with 0% down and rolled in the closing costs.

Currenty I am flat broke, lost all but four of the properties, including the one in question which I am about to lose, to foreclosure. Currently only one of the four is covering the mortgage and expenses. We are currenty renters in Nevada where we have lived the entire time.

I was stupid and used subrime mortgages. interst only mortgages, ARM and 30 yr fixed.  Currently of the four remaining, three are 30 yr fixed and one is interst only.

I know I  went a long winded way to get to my questions but I thought shedding some light on my situation would help.

I basically have four questions:

1- How do I get my hands on the information I am looking for on this rental property and the others to answer whether the lenders have the right to foreclose?
2- Is there anyway to fight the foreclosure on my own home?
3- How can I prevent summary judgments on all these properties? 
4- How can I get the ones I already have dismissed? 

I have nothing for them to take. My income is only my disability which cannot be garnished but I feel as though I can never get out of this hole.
My credit which was 780 is now shot. If I do ever have the opportunity to own something again I am afraid I will lose it to these summary judgments for the deficiencies.
