I have BoA and they are awful! I have been working on modification since June 09. Oct-Dec 09 I made trial payments. January 2010, made another trial payment - they told me paperwork at underwriting. February, made another trial payment...still at underwriting. End of Feb, told me if I hear nothing call back in 1 week and ask for it to be escalated.
Beginning of March I called an still nothing, spoke with a supervisor who had it escalated to underwriting because they supposedly didn't even have a name of who would be working on it. She noticed that in my file I was declined for the modification in december but of course I have never received a bit of information and for 2 months, 2-3 times a week I am being told they are working on it. Called back last week and was told it was with a negotiator for workout.

Beginning of January they also sent me a letter stating that I had not made my trial payments so I had to send proof of my payments to them---which they took directly from a BoA checkbook and applied to my loan. Middle of February I was sent Notice of Intent to foreclose. I called and asked because I was supposedly in a workout and after 3 people some guy finally tells me my account was supposedly coded wrong.

Here we sit the end of March and there still nothing from the negotiator. I called yesterday and they gave me her name but of course there is absolutely no way of getting ahold of her. They told me that it would appear she is waiting to hear back from the note hold (freddie mac). My online BoA account yesterday showed workout in progress. Today I logged onto my account and that note is completely gone and they are saying there is no workout in progress. I called BoA and the phone reps tell me the same thing as yestersday. Obviously something has changed (97% sure for the bad knowing BoA) but of course I am getting zero help. I am SOOOO over this I am just ready to walk away. Sad thing is Citi modified my second mortgage from 10 to 2% in less than a month so I can't see why this is so frickin complicated.

Game plan now is I am done making my trial payments even though they encourage it. I'm sure they are just collecting as much as they can until they foreclose. House down the street from us foreclosed and is now on the market for $100,000 less than what we owe on ours and theirs is a lot nicer. I am going to save my money, take my time to find a rental and file bankruptcy once I move. After 10 months, 70 pounds, 200+ phone calls and tons of tears later they have broken me.

I would NEVER do business with B0A again in my life and am going to make it my mission to campaign against them with everyone I meet. I am a very vocal person and am not embarrassed to tell my story. We fell behind because my husband had major medical issues and all I asked for was some help to get back on track which they are completely unable to do.

I'm off to email my state legislators now.

Correction, we entered the agreement on 2/15, not 3/15!
I confirmed that they received the payment as well, with THEM, not just the post office.
I was told I could make the payment at my branch, but then learned that I had to mail it, had to send it special delivery to arrive on time, since 2/15 was a Holiday!
So I KNOW they got it. How can they set a sale date with a forbearance in place, after their negotiator told me it would temporarily stop the foreclosure process while in effect????

I have been trying to get a loan mod since the beginning of September. We are with Wells Fargo, only recently learned they are our servicer and sold our loan to BofA. We were not notified of this sale, no clue when it took place, WF is still our servicer. We filed all paperwork, were jacked around for 4 months, having to resubmit repeatedly and never told exactly what they needed, what was missing, were denied more than once due to lack of documentation (always docs we were not told to submit, etc). By the time they came back with an answer, our financial situation had worsened and we no longer qualified for HAMP (according to them, who knows the truth, they refuse to tell you the figure they are looking for, insinuating to me that I might lie if they told me... Sure, my 3 mos of bank statements do not back up what I tell them, I guess - of course, the way these guys do math, I can see their concern). Anyway... We were forced into taking their offer of a forbearance agreement, entered into 3/15 and going thru 5/15, however, today we received a certified letter telling us they set a sale date for 3/25! And there is nobody for us to turn to for help, we are screwed and the government is deaf to this. Where can we turn for help? This is insane. By setting a sale date we cannot even arrange a short sale, and the grace period of the forbearance was just a lie. I need legal counsel, but where do I go for that? Nothing on the GOV site points to free legal aid. These banks need to be stopped, they are taking all my tax money and using it to sell my home out from under me!

Service Us Better? How about an education for starters and integrity would be helpful. Did you know that it takes more hours of education to be a hair stylist than it does to be a mortgage broker?

My Countrywide Story:

Laid off April 2008.
Could NOT find another job in North Florida.
Found a job in New England.
Called Countrywide and asked them if they could agree to a short sale. They transferred me to the workout department. THe workout department didn't know what a short sale was and sent me back to the main number where I was disconnected.

Repeat the above 2 sentences about 10 times over 10 days and you'll see the gist of what problems I was having. Finally my real estate agent found the name of the one person at countrywide who knew what a short sale was. We then got the paperwork and got it filled out and were pre approved for a short sale.

I've been in New York for about 6 months now without my wife + kids because I can't get a place to rent because of my destroyed credit.

I may end up having to quit my job in about 3 weeks if I can't find another place to rent.
