Attorney General Bill McCollum has filed a lawsuit against a South Florida loan modification firm and its affiliated companies, alleging they violated Florida law by charging up-front fees for foreclosure rescue services.
The civil lawsuit, filed in Broward County Circuit Court Thursday, charges several entities — Keep Your Property, its owners William R. Colon and Carlos A. Hernandez, and Centro de Prevencion y Educacion Corazones Unidos H.I. Visida, Inc. and Economic Alliance Group — with violating state laws on deceptive and unfair trade.
The Sun Sentinel could not reached Colon and Hernandez for comment.
Consumers told state investigators that they paid an up-front fee of $2,200 and monthly fees of $550 after the company guaranteed to file all the paperwork required to prevent foreclosure action or lower mortgage payments.
But many consumers found later the company failed to contact lenders and take any action on behalf of homeowners.

Is their any chance of retrieving funds lost to the “Keep Your Property Scam?
Here in good ol’ California, our Department of Real Estate has a recovery fund that can be accessed when a licensed agent or broker violates certain laws (I know because we’ve gotten some money from them for our clients).
