We received a certified letter today from ETS for the sale of a property for LESS than 30 days in CA ! using the EXACT bill referred to above!!!! which doesn't supposedly go into effect until June!!
MORE BANK FRAUD! I'm glad the FBI is finally locking up the mortgage brokers, but what about the "dirty work companies" using the laws with the original purpose to protect consumers, which these guys are using Fraudulently against the consumer. Hey, give the consumer a fighting chance at least!
Lock 'em up now, BEFORE, NOT AFTER the people lose their homes!-
Here's the quote from the letter:
Pursuant to Ca Civil Code 2923.54, the undersigned, on behalf of the beneficiary, loan servicer, or authorized agent, declares as follows:
(1)"The mortgage loan servicer has obtained from the commissioner a final or temporary order of exemption pursuant to Section 2923.53 that is current and valid on the date the notice of sale is filed,
(2) The timeframe for giving notice of sale specified in subdivision (a) of Section 2923.52 does not apply pursuant to Section 2923.52 or 2923,55.

My servicer is located in Des Moines, IA, am I safe to use the law against my services, they are doing nothing on my request for modification instead they are harrazing us on Foreclosing my house. I just want some modification or reduce interest, because we want to stay home. Today I received notice of default that is recorded with the county (4mos default) Sir/Madam, please help us save my home.

No need for name calling. a deferred arm with 0 % would be 1388/mo without property taxes. Given the goofy neofraudulent lending of the last 10 to 15 years, NOTHING would surprise me. How else could a shack your grandparents built for $350 in 1917 cost $500000. The NAR is who needs to get real and take some responsibility for their complicity in the mess that was created buy perverse, greedy corrupt incentives which seem to have no end or limit in the minds of the gratuitous criminals at the helm. It simply makes the Robber Barons blush.

Half a mill at 1500 a month. Are you stupid? Do the math bimbo that could never happen no matter what scenario you come up with. I guess you never graduated college or probably HS. 500k a month at interest only at5.675 is 3400 with property taxes. Even if you subtract the prop taxes it is still 2500.

Shitty plans, Shitty borrowers that think they can lower their payment when they arleady are at the lowest they can be. I mean be freakin reasonable that the banks are attempting to do all they can but when you deal with a borrower that has a 500k loan and a payment of 1500.00 it simply impossible to reduce the payment. They are on negative arm loans and should of never gone into them. Normal calculation would tell you that is not a normal payment on half a mill loan. Borrowers that are not in a financial hardship claim to have one just jumping into the bandwagon making it harder for those who really need the help!!!!!
