The company, Nations Housing Modification Center (NHMC), Glenn Rosofsky and Bryan Rosenberg were investigated by ABC News and I applaud them for shining the lights on these mortgage roaches in San Diego.

One loan modification firm that ABC News has learned is currently under federal investigation is Nations Housing Modification Center (NHMC), which boasts a prestigious Capitol Hill address, right on 611 Pennsylvania Avenue in Washington, D.C. According to NHMC’s mail solicitation, the company’s staff of “attorneys, forensic accountants and lender specific negotiators” could help homeowners lower the principal on their loans and reduce their mortgage rates “as low as 2%.”

However, ABC News found that the Pennsylvania Avenue address for the firm is really a mailbox at a UPS Store in D.C. NHMC is actually located in a nondescript office building in San Marcos, CA, where, as part of a “boiler room” operation, telemarketers read from a script tailored for anxious homeowners, according to a former Nations employee-turned-whistleblower.

The Federal Trade Commission has negotiated settlement agreements with the three individual defendants named in the FTC’s business opportunity fraud case against Second Income, Inc. and Silver Shots, Inc. that will put at least $80,000 into a redress account for defrauded investors. As one of more than 80 cases filed in a nationwide crackdown by federal and state law enforcers on business opportunity fraud, the FTC had charged these defendants with making false claims about potential earnings, profitable locations and compliance with state licensing laws, in the course of selling their vending machine game business opportunities to consumers. The settlements, which also include prohibitions on the alleged deceptive claims, are with Alan L. Rosofsky, Glenn Rosofsky and M. David Silverman, all officers and owners of one or both of the firms.

The defendants are based in Baltimore, Maryland. The business opportunities they promoted included the chance to own and collect money from coin operated machines called the “Water Bloop” quarter machine and the “Silver Shots Countertop Cash Machine.” In its complaint detailing the charges, filed in July, the FTC charged that the defendants falsely claimed that purchasers could earn as much as $300 per month per machine and make up to a 300 percent return on their investment within a year. Few, if any, investors attained such levels, the FTC alleged. The defendants also misrepresented that their locating companies typically were successful in placing the vending machines in profitable locations, and that they had obtained the consent of various merchants to place the machines in their stores, the complaint states. Moreover, contrary to the defendants’ alleged claims, the Water Bloop and Silver Shots vending machines do not comply with some states’ registration, licensing and other laws, the FTC charged.

Nations Housing Modification Center guaranteed a plan or your money back. Not only did Nations Housing Modification Center NOT get a loan modification for us, Nations Housing Modification Center actually stalled us by not calling us back and giving us the impression they were working things out with American Home Mortgage Servicing Inc.

Decided once I got a foreclosure notice to not use their services, and instead to go with a short sale since my home’s value has decreased by 100k over the last year and I’m owing more than its worth. Left several phone messages and sent an email telling them I was not going to be using them after all and I wanted the 1000 refunded (they say they offer money back guarantee)

Without my permission, they took another 2 payments of 1000 out of my account, citing that I was recorded agreeing to their cost of 3000 for services ( nevermind that I was told I was only having to pay 1000 down and that was fully refundable if I decided to not use their services)

    I also am losing my home and am currently renting a peice of land that I have a double wide trailer on that was givin to me that I moved. I payed 2500.00 to the company with the same money back guarantee as was given to everyone if the loan was not modified! Last week I called and the phone line said no one at this # currently then I called Brian Rosenberg and his # said old # so it gave new # that went to nothing!

    Some legal action should be taken against NHMC – they have my whole personal life in paper (including my SSN). I hope it doesn’t get me in more trouble.

    I just contacted my Credit Union to let them know I am not authorizing any other payment for NHMC – already got $1,500.

    I too have sent all mine and my husbands personal information and our SSN to NHMC. I sent them $2,500 up front with the agreement that they would modify my loan or a money back guarentee. I sent them all this information back on May 16, 2009. Lets get together and put these people in jail.

    With every part of my life in the toilet, I sign up out of desperation with these crooks. My wife even talked to Bryan Rosenberg on the phone one day. He told her how great everything was going to be for us. After they took our money the second time without written authorization, they created a paper crime felony. Now that BOA is on the case along with the FBI, these punks will end up back in jail. I can not beleive that they are not there already. We will get our money back thanks to BOA being a STAND UP bank and I am sure that this scum will get scraped off the surface of this earth and put where they belong!!

    Hi guys, i want to die. I just found out that the whole thing was a stupid , cruel scam. I have my loan thru Indymac , they told me that they were not going to be able to help me out with the modification of my loan, so i got a letter in the mail from NHMC , I HAD NO CHOICE , i did give them 3000 dlls . Now i dont have 401k plan no more i am going to loose my home i don’t have money to get an apartment. I can not belive they are doing this to us . I have a wife and 2 beautiful kids 5 and 2 yr old, i live in Santa Fe New Mexico.

    I was getting forecloser notices on my farm. I recieved a letter from the LMRA and I gave them 2500 to help me . Now I’m going to lose my farm. I just wish I could get my money. Why are people out to hurt other people.

    I knew I should have trusted my instinct. We, too, paid these scum bags $3000 to get our mortgage modified. I even received letters from my lenders informing my they had received a letter from NHMC re: their involvement. Making it seem more legitimate. I hope there is something we can do to get our money back. Sounds like they promised all of us the same stuff. I even asked to speak with, and did, the main guy because of my concerns. They said how our conversation would be recorded to protect us. Yah, right. That was a good line. i just hope it’s not too late for our home. We have 7 children, 6 of whom will still provide for. There is no way we could deal with losing our home. I really don’t know what we’re going to do. I’m calling my lenders, the IRS, the credit bureaus, and our bank first thing in the morning. They have all of our personal info: SSN ( for us and the kids), copy of drivers licenses, bank statements, IRS release, pay stubs, and copies of all our household bills with account numbers. OMG!!! They could absolutely ruin us. Let’s all stand together and nail these scum bags.

    This company also took me hook, line, and sinker. I have, as many have, some very difficult times in the past 6 months. Loss of employment and the birth of a new son, have along with some other things, put my family in a really tough position.. I received this letter and thought why not contact them, and find out how they can HELP.. Prior I had spoken to my lender and sent them All necessary documents and hardship forms for their assistance. Since they had declined to assist I needed somewhere to turn.. This company promised the world, and kept in excellent contact with me, until they had all of my financials and ssn.. IN the next couple of weeks I heard no more.. They also withdrew $2500 additional from an account not belonging to me.. It was from someone who was willing to aid my family in dire need.. I feel horrible, embarrasment, and violated.. Someone please help me get the money back… As for my home of 10yrs, God help me to keep it for my family..

    Sadly, I too have been scammed by these bastards. I checked the BBB before even sighning on with them and was promised that they could work with my lenders to help get me something that would be more affordable and would help through some trying times. I also heard from my lenders that they had been contacted. I’m sure the workers on the phone were trying to do the right things, but the people at the top were nothing but crooks!

    If there is any interest in starting a class action suit, count me in!

    Please understand that many of you may never get your money back and that is the unfortunate affects of being a scam victim. I am sure they will be sued, fined and may go to jail. But my guess is there is no money left and the only thing that will teach them is jail time.

    My advice would be to pursue a loan modification with a non-profit like http://www.NACA.com or http://www.995HOPE.org and to learn from this all, move on and never let it happen again.

    nhmc is a scammed…i trusted this company so much to help me lower my payments…. i called so mush times n line is disconnected…i paid 4000 for this….money back guarantee as they said… whats gonna happen to us now…they told me not to call my lender as well…we are violated with this company….we will find a way to put this peaple in jail..thats where they belong!

    We were also ripped off by the !!!!! for $2500 and was told that they offer or money back if they could not get the loan modified.
    After many phone calls to the company and no return calls, we filed a complaint to the FTC. As of now we know that in order to get our money back we had to call the San Diego District Attorneys office.
    So anyone wanting to try and get their money back should contact the San Diego District Attorneys Office.
    I DO NOT KNOW HOW THESE PEOPLE CAN STILL DO BUSINESS AND SLEEP AT NIGHT KNOWING THEY HAVE TAKEN ADVANTAGE OF EVERYONE.
    I THINK IF THEY ARE CONVICTED OF A CRIME THEY SHOULD NOT BE ALLOWED TO OPEN A BUSINESS OF ANY SORT, BECAUSE THEY HAVE BEEN CONVICTED BEFORE.
