During their hey day, Federal Loan Modification Center (AKA Fed Mod) may have been the largest foreclosure rescue operation on the West Coast. I don’t think there wasn’t a time in 2008 or early 2009 when I would turn on my TV and see thier cheesy loan modification commercials with paid D list actors.
Word on the street was that these guys were signing up thousands of homeowners monthly and when they were finally shut down by the California Attorney General, DRE, Bar and FTC, there were approximately 5,000-10,000 homeowners who may have been victims of the scam and are still in desperate need of help.
On July 13, 2009 the California State Bar filed charges against Nabile Anz, who was one of the owners and only licensed attorney for the Federal Loan Modification Center of Irvine, California.
The Bar is charging Anz with:
- Aiding and abetting the unauthorized practice of law by permitting case evaluators to accept or reject prospective clients without consulting an attorney;
- Illegally paying commissions to employees, which, in the view of the State Bar, virtually guaranteed they would make misrepresentations to prospective clients;
- Failing to provide any legal analysis of the problems faced by his clients. Anz is not contesting the charges, but rather has resigned from the Bar. All work on Fed Mod files has ceased.
What should victims do?
On August 13, the Bar obtained jurisdiction over his Irvine law firm and all Federal Loan Modification Law Center files. The State Bar sent representatives to Fed Mod in order to gather all files and records from the Irvine office.
