Barbara Desoer to take the helm at Bank of America?

Barbara DesoerGetting rid of Ken Lewis was one of the best PR moves that Bank of America has done lately and it looks like they may make another great move by replacing Lewis with Barbara Desoer, current President of the Mortgage Division at B of A.

Barbara Desoer has made great strides in the loss mitigation departments at B of A ever since taking over CountryWide’s massive and toxic mortgage portfolio. They still have a long way to go, but I have noticed a considerable difference in loan modifications and processes over in my forum at LoanSafe.org/forum. Yes, many homeowners are still getting the run around, but I have noticed a trend downward from the Countrywide days.

There even has been instances where Barbara Desoer and her office have helped struggling homeowners on my forum by responding to complaints and assisting struggling homeowners who are in precarious situations. I can’t ever remember Ken Lewis doing that and certainly I do remember Angelo Mozilo’s response to homeowner Dan Bailey in early 2008.

From the Deal.com

Barbara Desoer runs insurance and mortgage banking at BofA, which she joined in 1977. Most recently she led the integration of Countrywide Financial Corp., which BofA acquired in 2008 and in the process she launched the Bank of America Home Loans brand. Desoer also has served as chief technology and operations officer at BofA.

Desoer was the second Most Powerful Woman on Wall Street in 2008, according to American Banker, and was ranked one of the highest-paid women by Fortune. She is a graduate of Mount Holyoke College. Interesting trvivia, BofA bought Desoer’s home when it wouldn’t sell.

I wrote to Ms. Desoer today, asking that BofA Home Mortgage actually followup with documentation for the loan workout the company noted as approved on my web account. We now have great jobs, but my husaband didn’t for a time, due to a stroke, and subsequent heart transplant and rehab, which caused us to get behind in our mortgage. Unfortunately, BofA has chosen to call our loan in default and will not negotiate a repayment schedule, even though he is back to work, and our combined income allows us enough money to pay the mortgage and the amount in arrears. I guess BofA would prefer taking our house despite of this. And all contrary to the claims on their website of their wish to help, and undying flexibility in getting people back on their feet.

I know exactly how you feel and wish that somehow I too could get the right answer, and at the same time, know I am talking to the right people. I was told I now qualified for a home remediation but by the time they could send the paperwork, get it back and review it, my house could foreclose.
I have been hearing for 2 months that the packets with the home modification/remediation should be out shortly – first time I was told within 2 weeks and again this past week I was told the same thing – it is mentioned in my file, yes I did qualify, and it should be going out shortly.
None of this would have had to happen if I could have just had my interest rate on my current mortgage adjusted from 7.5% (which it is right now) to even 5%.
I am in the position now to make timely payments and if that could have been done I would have absolutely no problem with paying all my bills, the mortgage and credit cards included. Why would the bank prefer to foreclose when they could receive payments with just slightly less interest and keep people in their homes? I am being told that my only solution is to file personal bankruptcy – but why if I could make all my payments with just this assistance.
Even so, Bank of America has not cashed a total now of 3 mortgage payments having been sent to them. I am being told that Countrywide personnel did not advise me properly and that rules changed from 3 months ago when they took over.
When I read your information I thought the same thing is happening to me and the more I talk to people the more I hear the same thing happening to them. All of us are questioning who is actually getting help and how does someone get the right advice and also know that they are talking to the right person. It sounds like a lot of people could move forward, stay in their homes and pay their bills just if they received the proper information and guidance. How are we to know that the customer service rep working for the bank is not providing us with the proper information? Is anyone able to get something in writing from one of these customer reps that you reach when you call the number you are given?
Again as I said what could have solved everything from the beginning was just an adjustment in my interest rate on my current mortgage. I was told I would not qualify as the current rate of debt to income would not allow me to refinance. Sure – if you use the current figures, one of which is the mortgage payment that you are currently paying, instead of the one that you could be paying many people could not qualify. If the ration of debt to income was where they wanted us to be, we would not even be in the situation we are in right now. If they calculated using the amount that the mortgage payment could be at the lower interest rate I would qualify and so could many others.
Just to give some background – which is probably the same for many people:
My mortgage was with Countrywide, I had lost my company and my job due to the economic situation resulting in closing doors and letting people go that had been with me for more than 18 years. Personally I had tried to cover payroll for as long as I could. I used all my personal money and credit cards to keep on going – closing doors was going to be harder and I would be further impacting more people – their families. When I saw things were not going to change and some people were not going to pay their bills due me, and it seemed like it would be a long time before things got better I had to make the decision to close the office. We were all left without a job and I was in worse shape because I had also used my personal money and credit cards to try and keep my employees and pay bills for as long as I could.
As soon as I saw that I could not make my mortgage payments and pay other bills including keeping up with my health insurance, I contacted my mortgage compan, Countrywide, at the time – and I followed advice from CW from day one. I explained everything and told them that I would need 3-4 months to get back on track. I was told that I could not qualify for any of the programs being offered on the stimulus – home remediation/modification or any other program until I was at least 3 months behind in my mortgage payment. I was told not to send partial payments as a sign of good faith as I wanted to – they told me that they would not know how to apply them. At one point I did send a partial payment and it was returned. One other time it got posted just to interest and late fees and made it look like I was behind by one more month as nothing got applied toward the mortgage.
When I received the first notice that I was in jeopardy and could end up having my file referred for foreclosure, I contacted them immediately and was told that the only option I had was to pay the entire amount past due including all the interest that accrued and late fees. I was not given any other option or advice. At the time I still did not qualify, I was needing to be in default one more month, as well as more income. I was also approaching the time that I said I would need to get back on my feet and start making payments which I had always said was around 3-4 months.
I then tried to make an automatic payment over the phone and it was declined, not because of funds, but because they could no longer accept any payments from me. They referred me to the home retention desk and told me that Bank of America had taken over and that my file was sent on for review for possible foreclosure. I was so upset. I told them that I could pay my mortgage and was told they couldn’t accept any payments that I needed to wait to hear from an attorney as to what the full amount would be including interest and attorney fees. This was back in June and it wasn’t until Sept 4 that any information from an attorney’s office was sent.
In the meantime I spoke with the rep for Bank Of AM and asked what could be done to avoid anything from happening. She reviewed my latest debt to income : I had some additional sources of income and had reduced my monthly bills. With changes I had made personally I now qualified for a home modification. I was told that this paperwork would be sent in a couple of weeks, to start putting together all my financial information – they went over a list with me. And then they said that it could take several months and that there was no way they could put things on hold while my file was reviewed, there was no way to stop the house from going into foreclosure while this process was taking place.
I also asked what else I could do to stop the foreclosure – they said to pay the outstanding amount, which they could not give me at the time. I was told that I would receive a statement as to what I would have to pay, including interest, if I was to stop the house from further possible foreclosure while waiting for the home modification packets. I was told I would receive the information by mail within a couple of days, they could not give it to me over the phone and they could not email me once they had calculated a payoff amount. After a couple of weeks and not hearing or receiving anything, I called again and was told that yes, I had qualified, and that they were still waiting for the packets to send out which was taking longer than they had anticipated. How are we to know if this is all true?
Would be nice to have a letter that says something in writing other than form letters.
In the meantime I decided to show my intention of making things right…. I proceeded to send 3 mortgage payments, one every other week . Every check was clearly detailed and copies of letters were sent to both addresses – regular payment address and to customer service address [ one was Ft Worth, Texas and the other was Simi Valley, CA.] We were now into the 3rd week of August, still no paperwork/packets forwarded to complete for review of my financials and on top of that they have not cashed any one of the 3 checks sent that represented the principle and interest – my regular mortgage payments.
I finally received the first one back on Monday in the regular mail attached to a notice thanking me for making the effort, but due to the status of my account they would not be able to accept a regular check and was told I needed to send cashier’s check or money order only. Of course I called the number on the statement – it went to the home retention division. They confirmed receipt of all 3 checks – had the check numbers on my file. They also confirmed that my file showed that I had qualified for the home remediation [home modification] and that packets would be sent within 2 weeks. I told them that I had heard that before, but was assured that they had been waiting for the information they needed to send.
As I was asked to send a cashiers check I wanted to make sure that it would be going to the right people. There has been a lot of fraud going on and misrepresentation. I was given a different address than the one on the statement and had them note on my file that I was fedexing payment to the address they gave me that day [Ft Worth, TX] and it was being sent that same day to replace the check that was sent back. They asked if I would be sending a cashier’s check totally the amount for all 3 checks and I told them that I would send a cashiers check for each check they sent back to me. The last thing I wanted to happen would be that they would then cash one of my personal checks at the same time I would be accessing the same funds to send the cashier’s check and they would then say I defaulted for having sent a bad check. I asked for them to contact me upon receipt of the cashiers check and promised to do the same for the other 2 checks once returned. I received confirmation from FedEx that the envelope got to the location, but have not received any call as I had requested upon receipt of the cashiers check.
What I did receive however was a letter in the mail from an attorney today representing CitiBank [ have no idea how the mortgage was transferred to another bank - no notification] and was told about the intent to foreclose if I did not pay in full all the back payments, plus now interest and attorney fees]
Bank of America assured me that I would be getting paperwork for the remediation within 2 weeks however they could not guarantee that all the approvals would go through before a foreclosure would occur.
It seems that for some reason which does not make sense to me, they would rather have the homes foreclose for a fraction of the cost instead of working with the homeowner.
As today was Friday before Labor Day weekend, I will have to wait until Tuesday before trying to find someone to help me.
Even though I could begin making payments someone told me that my only option to stop the foreclosure would be filing personal bankruptcy. Unbelieveable…..
How does anyone trust someone at this point to give the right advice? How do you know that you are getting the right advice to get you out of the situation — how can you stop foreclosure, who will work with you just a little bit????
Are these home modification packets really out there?? Are they getting people’s hopes up by pretending to send them out only to find out that during the time they were actually just proceeding with a foreclosure??
Who can you trust, how do I even know that the cashier’s check that I sent this week really went to help me?? I made it payable to Bank of AMerica, my name and my account number. If they don’t acknowledge receipt, where is the credit going. I got even more nervous today when someone said that it could be very possible that Bank of America would keep the money that I just sent them, and not reduce the amount that is showing due to the attorney to stop foreclosure.
It also seems that the attornies were backed up with so many foreclosures.. I hadn’t heard anything, or any warning of being sent to an attorney until I insisted on sending a payment when I was told not to. Now after sending a cashier’s check I get something from an attorney and where is the money that I have now sent Bank of America going?
The banks are getting assistance from our government but it doesn’t seem that they are wanting to help the homeowners at all.
Does everyone need to file bankruptcy? At this point, my credit is so bad by following wrong advice I guess it wouldn’t make a difference at this point.
Sorry this is so long, but I really wanted to tell the entire story. I have a feeling there are a lot of people out there that have the same one to tell. How do we get our government to clearly see what is actually going on? Where are the people that have been helped? Can you trust any company offering helping you to get out of debt when you know you can with a little guidance?
I received information from a hot line that indicates that the mortgage companies were not legally complying or acting in the manner that they should be during this economic timeframe.
Of course now I don’t want to send any more money if I don’t know how it is going to affect me. Will it just be kept or will it help me from avoiding foreclosure? I can’t get anyone to give me an answer.

The sad thing is that I am in the process of getting a fairly good job. As for me, I think it is a great job. I said fairly because it may not be one of the highest paying jobs and I could probably get a job that would pay more, but it is a job that could help to make a difference in a lot of people’s lives – one that includes a lot of social programs in low income areas that will be incorporated into the job, allowing me to help a lot of people. I have been working for many years to get accepted in this position and now that I have I am wondering how would filing bankruptcy to help me save my house now affect my credibility with my new job? It makes it look like I am getting a job to help people and I haven’t been able to even help myself.
Over the years I used my personal money to help people and also to help keep everyone’s jobs that were working with me following Sept 11. With being hit once again with an economic challenge, I no longer had personal funds to support me through this. I still once again used all my money to try to keep my employees for as along as I could. Now I have really hurt myself and it seems that I cannot find anyone out there to help me turn things around and get back on track. The banks continue to deceive and hurt us and I do not know where to turn to get the right answer.
I hope someone out there may have been through this same situation and received proper help – I wish there was some way of knowing who the right people are to help you.
I hope people at Bank of America will in fact contact me and let me know that my efforts made and payments sent will allow me to have a chance to keep my home. Otherwise I have no other choice than filing personal bankruptcy.

Many of us are in the same position having been put down a path that was told to us incorrectly.
I have been in the position to pay my mortgage paymenst if they modified the interest – I currently have a rate of 7.5%. I could also pay all my bills and credit cards as well if they did.

You are all right on the mark! I am getting ready to submit my second request for a loan modification after being told something different each time I called to follow up on my first package from it is being reviewed or your ratios are too high and then we never received it! I am trying to find Barbara Desoer address so I can send a copy by certified mail to her. This was suggested to me by my second lien holder Chase who has been working with me a little but why not they have everything to loose. I have been a Realtor for 20 years and never seen a market like this living in the Inland Empire in Ca. If anyone can provide me with Barbara’s address I would greatly appreciate it. Good Luck to you all.

Yes, I am a Realtor and have also brokered loans but never in my life have I put a client in one of those loans that I knew they couldn’t afford! I seen this coming years ago with those sub-prime loans and all the lenders and Realtors who sold those to their clients cared about was making a buck in their pocket! My clients are for life and this all makes me so mad, where is President Obama? Can’t he help these people? If I can find a way I will post it for you all to see. Thank you.

Barbara are you listening? I thought you were here to help. I believe its pure greed! All these people need is for Bank of America and the other Banks who have been given billions in tax dollars to do to help these people is lower the interest rate on their loans and the length of the loan if necessary so they can afford to keep making their payments. The banks will make a little less in the long run but the economy and peoples lives will be better off. The banks have all ready been given billions of tax dollars to help these people but they are still not using the money for that purpose. Barbara look us up, help us all out here!

I think what we don’t realize is that Countrywide a.k.a. bank of america home loans is in total chaos right now. In my dealings with them, it seems as if the rule book and more importantly, the computer, are in charge and nobody is empowered to do anything at all. Also there is a concerted effort to make sure that problems are not passed upward to management. So you have a terrible contradiction; you are supposed to deal with the people who answer the phone, yet they are not empowered to do anything other than read you the rule book and do what the computer tells them to do. And to try and elevate your problem to a supervisor is a joke; that goes against their instructions. The absurd thing for me is that I am not even dealing with the kinds of problems covered here; I have simply been trying to PAY OFF a loan. But thanks to their incompetent allocation of funds, plus an incompetent adjustment to my account, they’ve managed to string out the process for an additional month, costing me thousands of dollars when they’ve had my money for a full month! Needless to say, my goal is to make their lives as ugly as possible – - to do at least as much disservice to them as I have suffered at their hands. Right now they are trying, for the third time, to adjust my payoff and refund me the egregious overcharge of interest. It will be interesting to see if any of the lemmings in that organization have enough power to over-rule Hal the computer. If not, I am going to their federal regulators, with CC: to the great Barbara Desoer. Then if no results, 24/7 blogging on their inadequacies until I get a response. Meanwhile, keep in mind that Countrywide was in crisis before B of A stepped in, and the messy integration has made things worse; nobody knows who’s on first!

JD, I hear you. I work for a mortgage company and run into your situation all the time not only with the banks but with the credit companys. It’s not the credit companys fault but the businesses that report to them, they do not up date your information causing such stress and loss of money to people. I do have to say I did contact Barbara via email and was surprised to get a call from her office the next day! Lets see if they come through with anything now? That will show me if she is true to her job!

Does anyone have Barbara’s email or contact number?
I have been getting the run around from BOA for months on our 2nd mortgage where BOA has not been updating my account properly. They asked for proof of flood insurance and it was sent to the department 3 times yet I was still getting calls and documentation that they have not received it. This was affecting my monthly payments because BOA went ahead and paid to cover my insurance then increased my escrow account. Now all my payments are higher and when I pay them they are not going through to show principal. I am now getting forclosure notices and every time i speak to a costumer service reps they tell me the computers are not updated and they will handle it when it’s fixed. This bank is a joke and has terrible customer service follow up!!! No one is actually handling this issue for me I just keep getting bumped around. Someone please help me get to Barbara so she can understand how screwed up her department is and hopefully fix this issue for me!

  13. Heather L says:

In March of 2008 we (my husband and I) were excited to sign for our own home and start the move in process. This was a gift from God for us as we had been homeless or living with relatives for so many years. Yet our blessing turned into a nightmare in a little over a year as the housing market crashed, leaving our home as not even worth half of what we paid for it.
In June of 2009 I started to notice that we were having problems making our mortgage payments and started the process of Streamlining into a lower interest rate so that we could stay current on our home. Our Streamline paperwork with Taylor, Bean & Whitaker (our home mortgage lender) was all set to sign on the 5th of August 2009, when the company was shut down due to fraud. The only information that I received on what was going on was from my Taylor, Bean & Whitaker mortgage Broker whom told me to “Google your mortgage company.”
Our FHA mortgage paperwork was held up during the transfer process to Bank of America Home Loans and was not received until the end of September 2009. When October 2009 came we received our first contact from Bank of America Home Loans stating that we owed $4,109.07 for August- October 2009. I was distraught to say the least, as we had never been behind on our mortgage before and thought that we were going to be lowering our monthly payments to $1,150.52.
When I contacted Bank of America Home Loans they stated that there was nothing that they could do and that if I did not pay I would receive a foreclosure notice. I have now spent the last six months fighting and begging for help with no help or end to this in sight. I have not been informed as to what is going on with my requests for help. I have been informed by my BAC Home Loans Servicing, LP, Kevin Alexander (1-866-788-8495, est. 2332, Kevin.alexander@bankofamerica.com). Mr. Alexander on all occasions has had no information on what is happening with my loan requests, other than that my paperwork is being processed. He has not returned my phone calls or emails promptly and seems to only know how to say “um”.
I know that Bank of America Home Loans, along with so many other mortgage companies have received help from me and other tax payers in the form of Bailout funds (totaling at $967,120,000.00), but were is our help.
I am trying to keep up on all the bills, pay for food, keep from becoming homeless and stay off the Welfare system. But it is becoming a fight that I am losing .
Barbara I want to be able to pay my bills, my taxes, and provide for my family. But unlike your organization and other banks and the stock market I do not get a bailout, a reset button, or a tax payer handout… I just get the bills every month for an over priced interest rate. We – your customers have given billions in tax dollars to help you from going under and to let people lower their interest rates on their loans and the length of their loans if needed so they can afford to keep making you a profit through their payments. So the bank will make a little less in the bottom line, but you will gain so much in the long run with your customers. Your customers and the economy will be better off. Use the $967,120,000.00 as it was meant to be used help people stay in their homes!
The US government has set up programs so that banks like BOA can lower interest rates on current mortgages from these high rates (mine is 6.25%) to lower rates so that people can make their payments and stay in their homes. Why would you prefer to foreclose on homes when you could receive a payment that have been just slightly lowered in the interest and keep people in their homes? Is it all about the money? I am not asking for a hand out, I just want my fair cut of that government help that I am paying for in my taxes, I want my payments reduced to keep my family from becoming homeless. I WANT TO MAKE MY PAYMENTS!

Hello Folks: I also need Barbara Desoer’s email address and phone number. I have been trying to get a loan modification for 7 months without success. They promised me one by February 1, 2010 and still haven’t delivered. Please emial me at mailto:pastori@cox.net. Maybe if enough of us send her email and call her she will know that the extra people that were hired to help us aren’t doing their jobs.

When you talk to them on the phone they are saying it takes 45 to ninety days before they will even look at your application because they don’t have enough people. They even outsourced part of my process to a third partyto collect documents. Obviously they can’t find a sufficiently competent person to do the calculations, enter the information into the computer and make a trial offer on paper.

The other problem is that theyhave so many different computer systems that don’t talk to each other. They have to update the same information in 3 different places to make any changes. No wonder we are all so frustrated.

July 26, 2010 LETTER REQUESTING HELP!
Attention: Bank of America and ReconTrust,
We have been doing much research on what Bank of America has been doing to poor innocent people like us. Defrauding innocent people. Some losing their health and even committing suicide due to what Bank of America has done to them. We are praying that Bank of America doesn’t do this to us, but it looks likely that they are. In which case we will take legal action against them.
We submitted the most updated personal financial statements we possess to NACA on July 13, 2010, who in turn submitted them to Bank of America on July 14, 2010.
We started this whole process over a year ago. Feb. 11, 2009 we faxed all the documents requested of NACA, and Feb. 13, 2009 we faxed the NACA Member’s Authorizations form along with more financial documentation NACA requested, who in turn submitted these documents to Bank of America.
We received a loan Modification Agreement from Bank of America in July 2009 which we were to sign, have notarized and send back to them by Aug. 10, 2009. We did as instructed. The new loan payment was to start as of Sep. 2009. We began making the new payment as instructed at that time. We have not missed a payment since. But we continue to receive statements with the old payment amount and unpaid balance. We also have been getting Notices of Intent to Accelerate. We have faxed some of these to NACA as well. We have now received letters from ReconTrust stating that our account has been referred to their office to begin the foreclosure process. We have included these letters with all that we have faxed to NACA.
We have been in contact with NACA and they say they don’t understand why Bank of America is not honoring their contract with us. We have also been in contact with Bank of America’s advocacy group several times. We spoke with a Bank of America negotiator who said they received the documents on Aug. 17 2009 that we had notarized and sent in for the modification. We even had a three-way call with NACA, Bank of America and us and no one could tell us why things were not closed by now. We have also contacted ReconTrust as requested in foreclosure notices and they tell us they will escalate it and get back to us but no one ever does.
We have resent everything again, including an updated budget. We don’t understand why this is happening when we already signed an agreement for a modification and have been making the payments according to the new agreement since.
We understand that in such large corporations there are various departments that handle certain duties, but PLEASE, there needs to be more interoffice communication. As the foreclosure entity of Bank of America, can ReconTrust please communicate with Bank of America’s modification department to verify the modification that was instituted by Bank of America itself with us. This has been extremely frustrating and stressful for us. If we are foreclosed on illegally we will be forced to take legal action against Bank of America due to the fact that we have honored the modification they instituted with us in July 2009. Why can’t Bank of America just honor the modification so that this nightmare can end?
    CAN SOMEONE PLEASE HELP US!
    Sincerely,
    Edward K. Savery

I have a tricky situation. I had purchased a home before my marriage that was in my name only. I then bought a home right before I got married with my wife. I used $90,000 on the equity of the first house for a down payment on the 2nd home. My wife was mistakenly put on the HELOC loan. I have fallen behind on the loan and it has affected my wife’s credit. I went to the title company and they admitted she was accidently put on the title. They said I have to talk to B of A to get her off the loan. I’ve called and just was transferred for hours. I just need her to be taken off the loan. What should I do? Please help.

Below is a letter i emailed to bank of america. with no response. if anyone know who i can contact to get help. i would appreciate it. or if you have any ideas. my email is AmandaHyde@bellsouth.net

    Hello,
I am a customer of Bank of America. I have been for many years now. I have a home loan that i have been trying to get modified for 10 months now. I have gone threw 2 negotiators 5 manager supervisors. And customer service. I have faxed and mailed all docs needed 10 times now. Customer services has verified receiving it every time. but, yet i am being asked again to produce all documents over for a new negotiator. The court order i have is the same as the past 10 times i have sent it in … it does not change. I can understand updating financial, but reapplying every month for a modification is crazy. If Bank of America is loosing my info, this greatly concerns me. my personal and private info is all over the documents i send in. The loan modification dept consistently keeps denying my loan and sending me to forbearance. Forbearance sends it back because all income is not counted. Forbearance tells me i meet all requirements of a modification, and sends me back to modification dept. When i call customer service they state that they can’t transfer me to a manger that can help nor do they have access to higher rank managers of modifications. And a negotiator never calls me back. And neither do there supervisors. I am beginning to believe that bank of America does not intend on helping there customers with there modifications. And is simply interested in playing a cat and mouse game till homeowner gives up and looses there home. Or pays off the home. I don’t believe that being a customer of Bank of America should be this hard. All i am asking is that someone with the power to help me please call me back or email me.
