Green Credit speaks

green credit solutionsGreen Credit Solutions, Law Center, Holding or PacWest Funding (not sure what their true name is?) reached out on my blog in regards to a post I did two weeks ago called, Green Credit Law Center, Solutions – Tell us your story!

Not to my surprise, I received a lot of comments and what appeared to be Green Credit insider knowledge. But the two comments that stood out were from executives at the loan mod firm. I thought I would give them the podium here and just copy their comments.

Per Green Credit and executive Larry Bracco, they are too legit to quit and are still very much in the loan modification business! Well OK Larry….

Green Credit Solutions DRE approval is listed under the company name, Pac-West, which is a Green Holdings, Inc. company, and Green Credit Holdings and Green Credit Solutions are licensed under the DOC. This is permissible in California. I verified this with several attorneys who represent modification companies and with the state of California.

I have been working with Green Credit Solutions since Nov. 2008 and they say they nearly have a loan mod. done for us. This past week I have left a few messages on the phones as well as sent a few emails with no response. My question is I’m in trouble? Should I ask for my money back and seek better advise? The people at Green Credit Solutions say that an agreement with my mortgage company is near but when. The person I have speaking with at Green Credit has been Hector Montes and Nicole Johnson.

15 Larry Bracco August 5, 2009 at 2:52 pm [edit]

Hello folks…I am an executive at Green Credit. From time to time I browse the blogs about loan mod companies, seeing what people are saying about Green Credit and the industry in general. I see “moe” here has another one of those websites dedicated to helping the poor, un-armed masses against the big, bad scamming loan mod companies…

The plain truth is that Green Credit performs between 400-500 loan mods per month from all over the country. We are not perfect, in the sense that we don’t always answer calls/emails as quickly as we should or would like…but the VAST MAJORITY of our clients are extremely happy with our services. We have been doing loan mods long before the CA DRE got into the business, and we work very hard at doing something we are passionate about…saving homes from foreclosure. We get complaints, like every other service business, except that for us the stakes are much, much higher. We try to deal with each and every complaint, and if warranted will refund a clients payments even if we have performed. Our clients are afraid, stressed out and confused. We understand that. They want their problem fixed immediately. So do we. The fact is, the longer it takes for a mod to be completed, the more money it costs us. If we charged by the hour, like a regular law firm, the average loan mod would cost over $10,000. And I can just imagine how easy it would be to collect that fee from a client AFTER we got them a loan mod. We don’t force people to engage us. The vast majority of our clients come to us AFTER they tried to get a mod on their own.

I have reviewed the files of a couple of your post-ers who are GC clients…I will not go into the specifics of their cases, because that would be a breach of confidentiality, but I will say that there are always at least 2 sides to every story, and in these cases…many sides. And both of these folks have been in contact with us since their posts, and things are getting done.

In the loan mod world, many times the client is their own worst enemy. They got into a difficult situation, sometimes through no fault of their own but in many cases the client has helped themselves get into difficulty. We have to sort thru all of this, get the correct information and documentation to the lenders, who are more screwed up than you could EVER imagine, and try to negotiate a solution that works for the client for the LONG TERM. The reality is that we simply do not know how long its going to take for a mod to happen, it is primarily up to the lender. Most of our efforts go into preparing the case for negotiation. This is where the rubber meets the road and why more than 90% of the mods we’ve completed are still performing today.

As for the whole issue of “compliance”….it is going to be a moot point very soon, as the wise politicians in the great state of California are going to pass HR 94, which will basically “desist and refrain” ALL loan mods in this state. This is exactly what the lenders want, so companies like ours who successfully perform loan modifications EVERY DAY, will no longer be an option for consumers who do not have the time, the stamina or the experience to negotiate with their lender.

So yes, we got a “desist and refrain” notice from the CA DRE. And yes, we have now and have had in the past several Advance Fee Agreements listed on the CA DRE’s “no objection” list. And the point is….? The CA DRE sent us that as a result of 6 (or maybe it was 9) files we took in during a 2 week period we were developing various business models. Mea Culpa. Like most businesses, our objective is to make a profit. We do this by generating customers, getting them to pay us, providing a valued service that costs us less to perform than we generate in revenues, and hopefully get those consumers to refer us to others. We are still here after more than 2 years, in spite of the roadblocks, chest-thumping politicians and irresponsible jounalists (and bloggers) depicting this industry as full crooks and scammers. Please…there are a lot more crooks and scammers in such honorable professions as home improvement contractors, plastic surgeons and auto repair. Do the research…

Meanwhile, if you are a client of Green Credit, and are having concerns or problems, you can email me at larryb@pwfinc.comand I will do what I can to help you. Krista knows that I answer my emails and help our clients who may need a little extra help…she has seen the process work on Trulia.

Its pretty much a thank-less job that we do. We do all these mods every month and very few people take the time to blog a “thanks”…that’s ok. At the end of every day, and email goes out to our entire company summarizing how many homes we have saved from foreclosure thru modification, forebearance, etc…That allows us to sleep at night, and get up the next day to do it again.

OK, Larry and anon.

I appreciate that you both have came here to clear the record. But I am still confused as are many readers of my blog.

Why have you just changed names? Why are there so many names, aka’s etc? Solutions, Law Center, Holdings and now Pac West! Gee whiz guys, will the real name please stand up? Is it Green Credit Solutions, Law Center or Pac West?

Whatever it is, I see no transparency and just a bunch of fishy name changes. You all need one clear message and not so many websites and confusing business models. One day you are a law firm then the next you are a processing company and the next you are a holding company.

So this is the company that is licensed to perform loan modifications under the DRE? http://pwfinc.com/ and this is the license? http://www2.dre.ca.gov/publicasp/pplinfo.asp?License_id=01525143 and is this who does your marketing? http://www2.dre.ca.gov/publicasp/pplinfo.asp?License_id=01859050. Geez, so much darn confusion and so many companies.

Please clear the air on these issues.

It looks like per the DRE that PacWest Funding just changed names to Green Residential. http://www2.dre.ca.gov/publicasp/pplinfo.asp?License_id=01525143. So PacWest is no longer in existence ? Is this really a shell game and I lost the prize??? Come one guys, please tell me. The suspense is killing me!

I am sorry guys, but NOW I am even more confused!!!!!!

Chirp, chirp…… the crickets on this post said.

  2. karma says:

so their websites are down, the 800 number isnt working.. i truly hope they are not able to reopen under any name whatsoever. who knows whats happening with the mod files in place already, i heard they are being sold or transferred to some attorney. green is now going to try and become solely a debt settlement company i hear, they have partnered with Home Loan Preservation which is a huge network of people who work independently, mostly from home. Kind of like a MLM type operation lol. get em moe!

  3. karma says:

well the word is that green credit is dead and the new website is http://www.getmycreditgrade.com. lets see where this goes!! are you excited??!!

  4. frusttrated says:

So those of us who paid our “retainer” what will happen next. how do we get our money back. Do we contact the dre? wtf am i supose to do now?

  5. ROBERT says:

Want to know the truth? We have been an affiliate for over 2 years and they even screwed us let alone the 30 files we have with them.
We have been the only ones talking to our clients. They lie about status on files or even that they have left messages for them.
Our original contact at Lender Implode has tried to move words around and defend them because they were his biggest clients. I even shared an office with the con man.
The truth is here waiting to be heard cause the CEO is in complete denial of the infrastucture collapse.
They said they had been closed by the DRE

  6. ROBERT says:

To finish…we were told that the reason for the DRE shutting them down(from a board member) was that needed to catch up because they are behind and in mash mode and will not take on any new files…..well found out from one of my clients I sold that was not the truth and they are still taking on new business.
Bottom line….lie to us….here comes the bus! We were trying to build our business of 15 years around this new program and got lied to…. like the clients we sold.

  7. So frustrating says:

We, too, signed up with Green Credit Solutions in December of ’08 and foolishly paid $3495 upfront. I contacted Larry B who did seem to get a few phone calls made but now there is silence (again). I have written him twice requesting a refund but no answer. Finally yesterday we get a phone call from someone from “Guardian Credit Services” who says they will now be taking over our Green Credit account. When we pressed for answers, the person “Ryan Johnson” saod through broken English that he was just the messenger and did not know anything about our particular situation. When we told him we were trying to get a refund he again repeated he does not know any particulars, he is just calling clients to tell them about the switch.

So what do we do now??? All we want is our money back.

  8. Moe Bedard says:

I am sorry to hear about your troubles. If that is what your truly want. Demand your money back.

Who did you pay, Green Credit or a Law Firm? Who introduced you to Green Credit?

You can either pursue them yourself or turn them in to legal authorities. If you want to do it yourself, get aggressive and call often and if they don’t help you and refund the money or get your loan modification, then you can pursue legal recourse.

The California Attorney General set up a website that you can go to and file a complaint. Here it is. http://ag.ca.gov/loanmod/

  9. So frustrating says:

We paid Green Credit Solutions the $3495 directly. We were introduced to them by Chris Sutherland of Paramount Equity.

The link to the Attorney General doesn’t appear to be working. Is there a typo?

  10. Moe Bedard says:

I would make sure to list Chris, his contact info etc and how this happened because I am sure Chris got paid a pretty penny to refer you to Green Credit.

Sorry about the link, here you go http://ag.ca.gov/loanmod/

I wish you the best of luck and make sure your pursue getting a refund hard this week because I have a feeling there will be no money left for anyone soon.

  11. SweetlilJilly says:

    Dear So Frustrating,

I’m in the same boat. I paid the same amount, was also referred to by Paramount Equity and was told by Nicole Johnson with Guardian Credit Services, today that I won’t be getting my money back. She said they have been working really hard on getting me a loan modification and that they have put in a lot of time and money in on my account. Funny thing is, I didn’t know who Guardian Credit Servies was. I didn’t get a phone call until I was given a website by another blogger to getmycreditgrade.com, which I contacted and was familiar with the Live Chat person. It was one of the same people I chatted with live on GetGreenCredit.com.

I was told from Annaly Sosa the live chat person to contact an 877-318-8284 and speek with my loan negotiator Salma Mushtaq but when I called the number it lead to a Deann Anderson, so I left a message for her. I stated I filled a complaint with the Better Business Buearu and the Federal Trade Commision. Guess who called me back…Nicole Johnson, go figure. Different numbers, different websites and same old people. I’m upset and all I want is my money back. The disconnected their website, disconnected their phones and changed their name(s) and never once contacted me, their customer who apparently had a loan they were working really hard on.

  12. Karma says:

Guardian Credit Services is the new name of their processing team, while the sales is under getmycreditgrade.com. I dont see how they can stay in business. The attorney general hopefully will step in and shut them down.

  13. david says:

I have been with green credit for 5 months and have nothing from them. My broker has sent over 20 clients to them also and they have nothing from them also. This company is a BIG SCAM! Thet are just smoke and mirriors! Give you the run around every time you call them. I would not refer anyone to them. They will just take your money. Stay away! Don’t get scamed like me.

  14. Mike M says:

Same deal. Lisa Knight at America Funding referred me. She later told me none of the 5 people she referred received any results from Green.

I too am out $3590 and want my money back.

    Mike

  15. Barbara says:

I am like all of you – out $3495 and all I want is my money back. We were originally working directly with our lender for a modification, but weren’t getting too far. We hired Green Credit in April 2009 and they did not do their job. We were offered a modification in June 2009, but it was directly from our lender and based on the information we had submitted prior to hiring Green Credit . When asked if they had spoken to Green Credit about this modification, they replied that they had not, didn’t even know we were working with a mod. company, and that no phone calls had been received from them. 2 months an no contact with our lender? I requested a refund on June 25th 2009 because Green Credit had nothing to do with our modification and in fact hadn’t even contacted our lender and haven’t gotten anywhere. I can’t even get anyone meaningful to call me or reply to my emails. The two people who have contacted me were new to me (had never talked to them before) and less than helpful. All they do is claim that Green Credit did indeed get the modification for us, which I know isn’t true. I called my lender again to see if I could get proof that Green Credit wasn’t involved, and they told me that Green credit called them for the 1st time on June 26th, the day after I requested the refund!!! And yes, they can send me verification! So now I have proof, but still don’t know how to get my money back! These are horrible people, really. They sell themselves as stand-up people, but back it up with nothing. What a disappointment.

  16. Patti Holland says:

Same boat here. $3495.00 stolen. They didn’t do a thing for us. We even looked at the banks records personally. They were never contacted. We had 4 different people “in charge” of our account.
They told us the 1st woman was fired for not doing her job :)
Who can help us??? I’ve been calling Paramount mortgage for help since they set it up for us. I’ll let you know if they come through for us.

  17. Erik says:

I too got scammed. Gardian credit took over the mod I guess. I told them I wanted my deposit back. They told me they wernt obligated to do so because their not green credit… So, is there a way to get anything back even though green credit is “gone”??? Im pissed. Im so close to getting my home back too, I could really use MY money… CLASS ACTION LAWSUIT!

I called paramount. they never called me back…

  18. Brian says:

    Erik,

I could not have written it any better. Exact situation.
I am taking them to small claims court.

I too want to file a class action lawsuit. We need a lawyer…..

  19. Renee says:

I have been asking for my money back for a month! they said I can have it and NOTHING!
    I can’t beleive I have been scammed for 2500!!!!!!
    What can I do?

  20. TB98629 says:

WOW, how many of you were referred for mortgage modification to these companies by Paramount Equity Mortgage? I am currently involved in a little project involving predatory lending practices with that company, and I am seeing a huge connection here. I would like to know more.

You can see what our group has been doing here and contact me:
    http://www.socialapocalypse.com/paramount-equity-mortgage/

There’s always room for more, and you might get your money back. Their latest “Solar” project is probably keeping them busy, but I will not quietly allow uninformed fellow working Americans get HOSED by these guys without voicing my opinion. They hurt my family deeply, and many thousands of other families as well.

MOE! Thanks for ONCE AGAIN shining your big bright light on the cockroaches.

I remember when I was speaking with one of the owners of Paramount Equity Mortgage earlier this year because of the horrific, toxic loans they originated for me, he wanted to refer me to a loan modification “partner” he called them. THANK GOD I didn’t trust a word he said by that time.

Sorry to hear they are still swiping dollars out of working people’s pockets. I will find it very surprising if there is not a very lucrative connection between the two companies and I am going to call my attorneys about it right now.

Keep sharing everyone! KEEP IT UP.

  21. Kim says:

I have been reading all of the comments and I agree with everything that everyone has said. We too have been scammed out of $4400. The good thing is that I have all of the paperwork and emails documenting all of the various attempts that I have made to try to speed up the process. In speaking with DRE today, I was told that Green Credit has been out of business since November of 2008 and did not have a license to operate. A man by the name of Jeffrey Chiuminatta was the broker that originally applied for the license for this company. He is no longer associated with this company. I then spoke to BBB and was told that Green Credit/Guardian Credit received notification on 6-25-09 to shut down business. I continued to receive emails and phone calls from this company up until October 22nd. Cassandra Emond 949-885-0133 emailed me to let me know what they were shut down by DRE. Well, come to find out, her broker license was taken away Nov 7, 2007 in which case she should not be operating at all with this company. She told me that she is sorry but she cannot offer refunds because they simply do not have the money at this time. I am not satisfied with that response and will keep doing everything that needs to be done to make sure that this group of con artists either finishes helping the customers that they have, refunds them the money that they paid for services that they have not received, and also to make sure that this doesnt happen to people that are looking for someone to help make their financial situation better. In reading the postings from some of the Green Credit employees above, yes, you are correct in stating that some people get themselves in situations that they have created. However, that is not the case with all homeowners. I am in the process of looking for an attorney that would proceed with a class action lawsuit against all parties involved in this apparant scam. I contacted Cassandra Emond and a man by the name of Matt and left my number to have them contact me to see about a refund. If I do not get any response, I am going to go to the media next week with the story. I am going to give them the personal names of all people that were supposed to help me on my case: Keri Perez, Jodi Lahman, Charles Cabollero, Linda Emmonds, Cassandra Emond. I know that getting my money back is probably not going to happen, but the principal is more important at this point. If anyone has found an attorney that is going to proceed with this case, please let me know, as I would like to be part of the lawsuit. In the meantime, I have filed complaints with every known agency and am sending them documented emails showing the lack of customer service. I am a firm believer in Karma and things do catch up to people eventually. Hang in there everyone! In the meantime, we contacted our banks and were able to negotiate with them independently. Both our first and second mortgage were willing to work with us and provided a long term plan. I urge you to do the same and have the mindset that things will eventually resolve with this company through the legal system.

I too have been scam by Green credit I payed 3,499 back in june and have not heard from them every time that I have called they said that it was up to the bank ,that the banks had a back log,how can i get my money back

  23. carmen robles-valadez says:

Well guess what I called Green Credit and left a message to the Asset manager Cristy Doorbetaki, and she did call me back and said that they could not find my record, that the the governor stop their actions , that they are in bankruocy and that I should call the lenders myself or get an attorney, I ask abot what about my my money and what did I payed them for she, stated that it was not her problem, that she only worked for them I asked her how come her phone still worked and the same number but note it is a called Get My Gredit Great, now that is still fishy a new company name the same number and the same worker, and where is my money

  24. patricia says:

I have read all these comments on Green Credit, Guardian etc. One name i have not seen is Darrin Miller, the person who took our money for a company that doesnt exist, but he now has a business card saying he is a managing partner of yet another firm.. which also used the same email and phone numbers of previous co names. I want to participate in a group class action against this company, the people who set up the company, takemoney and do nothing. I also ( as Kim noted) have copies of all emails, paperwork sent, signed and other info which was not in compliance with written documents. Numbers were changed on forms we submitted… fraud, fraud fraud. And the lies are so hard to get thru. Once day we talkedto Darrin, then Christy Door ( same person mentioned above) and in a few minutes received an ‘informationonly’ call from some yahoo there who was oblivious to our just talking to 2 employees, saying ‘we are working on this and it is almost finished’.. how do the scammers sleep. I have heard amazing stories, about sleepless night worrying about my modification.. i am certain the only person sleepless regarding MY loan is ME. Read all the websites availble on what to do, who to file with and lets all do this together. There is a lot to be said for numbers… media, media media.. public records of their homes? how about the email i received sent to 3 other clients.. somuch for privacy! And when i was upset about my name being sent to others I got a nasty email from Darrin telling me to ‘keep away from my clients’.. hey, i wasnt the one sending MY name to YOUR clients.. YOU did or so it seemed in your email.
Anyone wanting to file together to stop this company and all those representing it, email me …. numbers and media… it will work.

  25. Jamie says:

Hi I was working with Get My credit Grade and I spoke offten with Federico Rosal and Carlos Pena, that they where working on my modification… they havent relized that they are playing with peoples live`s I gave them my money expecting them to do something and they have done anything I keep on calling to the numbers that they have given to me and now they answer as Erickson Law Group, and Magus global, WTF are they still doing on the so called “BUSSINES” this is such a SCAM…

  26. Jeremy says:

I have known Curt Melone for many years, he is a scam artist. Do not do any business he offers. They are taking your money and running with it. I am serious, please avoid anything he is involved with. When they get caught or questioned, they shut down and open up under a new name and start all over. Contact the state and make the necessary steps. these clowns should be behind bars. Trust me, I have more information than you can fathom.

  27. Jenny says:

all the files have been transferred to 21st century credit group. they are using peoples SS#’s and personal info for fraud.

  28. JR Nuno says:

I have read all these comments and I guess i feel worse now then ever, I paid Green Credit a total of $5,300.00 and have been given the run around since Aug 2008. here we are the end of 2009 and I have just found out this Nov that they were filing Bankrupt. I have waited and kept paying my morgage and safing literaly every penny, and now I am out $5,300.00 and have no where to turn to, can someone tell us what to do?
