We too got a trial forbearance from B of A. With the promise of a more permanent modification. When we receive a statement the payments have not been credited. It's in some trust account. We been at this with them since Jan 2009. We finally had to hire an attorney to file BK and also go after a mod from B of A. We were stupid and tried to hire a modification company and got taken. So now we have a very reputable attorney that handles nothing but BK and modifications. It's a crying shame people are forced into this situation even when they do everything the right way. If B of A had the money to pay back TARP funds and are also getting $10,000. per applicant gov't gives them for considering a modification??? then where are these modifications???

Bank of America here in Nevada is not any better. That's a given since we seem to be number one in foreclosures. Once B of A took over our mortgage from Countrywide, we have had little to no help for a modification. We taken by a modification company, and have been trying to work with B of A and Chase on our own, to no avail. And I agree. You never get to talk to the same person twice at B of A. And as far as I can tell, none of them understand the Make Home Affordable Plan. I too would glady join in on a class action even if it does no good, at least we'd get their attention.

I am so mad I can't see straight. Bank of America does it again. They received 45 billion dollars from TARP and what do we get? Foreclosure notices. Not 2 people in the "Make Home Affordable" customer service department said the same thing. Each time I called I got different answers. I want to file a class action lawsuit or join if there is one already going in the state of California. They have done nothing and I mean nothing to help us. They actually increased our monthly payment. Somebody please say something to make m feel better?

QUESTION: Has anyone ever actually received a Loan Modification from BofA/Countrywide after the MHA 3 Month "Trial Period"?

I NEED ADVICE...
I have been on the MHA 3 Month Trial Period since January 2009. During this time, I received the packet requesting all of the docs needed to proceed with the loan mod along with a Fedex return envelope. I submitted all docs immediately but have not heard back from BofA since.

It has now been 3 months and I have not received any statements showing my payments nor have I received any communication from BofA regarding the status of my loan modification. I probed around my account online only to find the word "declined" listed next to the "workout status" section. I immediately panicked and called BofA. The first person I spoke, Nancy, said that I was not actually declined but rather "not assigned to a loan officer" then proceeded to say that my financial information was over 90 days old and that I needed to furnish this information again. Until then, continue to make the trial payments. After being somewhat relieved that I was not "declined," I proceeded to give her my next trial payment over the phone. Hmmmm, why did I have to call to find this out...they couldn't send me anything in the mail?

I called back an hour later to speak to someone else and the rep said, "I have no idea why Nancy told you to resubmit your financial information...we don't need this unless there has been any significant change in your income." After being put on hold for a long time, he came back with "it states in our system that you are approved to make more trial payments until May 2010...you have not been declined...you are still on "active review." IN OTHER WORDS, we haven't even looked at your case yet but still send us your money while we still report you delinquent with the 3 credit bureaus and continue to charge interest and late fees.

After reading numerous horror stories regarding BofA's terrible service and deceptive ploys, I'm debating on whether or not keep making these trial payments if there really is no loan modification happening in the end but rather a foreclosure...taking my money as "trial payments" but in the end will only foreclose leaving me without a home and without thousands of dollars. I'd rather save all those trial payments if they are just going to give me the run around for months and end up foreclosing me in the end!

I recieved too much help. I was laid off for six weeks last year and called and asked for information on the governments program to defer payments for three months, well they sent me the paper work and i looked it over. Maybe I'm wrong but it looked a little fishy, so I decided not ot sign up for it, and two days later BAC called and asked if i was still interested, to which i said no. They called two days after that and asked again, same answer, and i thought it was done, but it was just starting. I noticed that even if i payed my payment early, BAC wasn't cashing the checks i had sent untill after they were past due. After two or three months of that i decided to call them and to my surprise i got a voice recording that first asked me if a was an agent representing a client, then stated my home was in the process of forclosure. Well two or three hours later BAC was apologizing for their blunder of throwing us in a pool we didn't want to be in, and that they would contact the credit bureau and every thing would be fine. Two months later when my credit limits were cut i called again to hear the same message as before. Again with the apologizes and again with taking me out of the pool, credit bureau, etc.... Well, now, eight or nine months later, forth call, same message, i am some how getting a late charge for not living up to the obligations of this pool. My credit rating has literally dropped 100 points, my insurance is going to go up because of my credit scores, and all my credit card limits have been lowered to what i owe. Is there something anything i can do about this, i implore you?

Folks, I have been trying to get my load modified since August of 2008. This is a game. Not a particularly nice game but it is a game nonetheless. I consider it a very long game of poker. This is how I cope with it. I don't stress any longer. I used to. I have never had to go through a foreclosure process in my entire twenty five years of owning my homes. I pride myself in my personal integrity and committments. No longer. Not in this situation.

I have detached myself emotionally from my home and this entire loan modification process and I have to say, I think much more clearly. I think of my h ousemuch the same way as Donald Trump would think of his businesses. How the hell do you think this smart cat renegotiates with his bankers? He looks at his dealings unemtionally and through the prsim of a business transaction. If it does not work well he declares bankruptcy which forces folks to come to the bargining table.

The homes in my area (California) are down some 32-38% in value. Running calculations with calculators available on the Internet, assuming a 4% increase in home values, I won't break even until approximately 12 years assuming the bank "charges off" (and be careful how the banks define this term as well as they play games here too).

Why on earth would any bailed out financial institution have any incentive to aid homeowners after they received their monies from AIG and government bailouts? The answer is simple, they have no incentive to help. Are you kidding me, they're finding other ways of making money off this whole scam.

Company leaders of previous sub-prime companies are now creating "capital management" companies with "investors" who are buying mortgages (my research shows 2nd mortgages) on pennies on the dollar. Why? Becasue there's money to be made somewhere. I can only speculate how as I am not in the know of this business but if these assets are so "toxic" why are "investors" buying them? Because Dorothy, there's money at the end of the rainbow.

I subscribe to the "strategic default" pricniple. I am willing to let them have my home through whatever means (and one of which I can minimize tax implications and furture collection/judgements). But I will wait until the very end to let them take it.

This is a long game and Obama's HAMP plan (and by the way I voted for him) will be a complete failure. Saddens me to say it because I believed in hope. I will continue to hope but I will pray and row for the shore in this storm.

Does anyone know how to get a copy of your original loan docs from Bank of America ? We were originally with Countrywide.

Regarding our loan modification request started in July 09, I have emailed, I have called, I have done everything that Bank of America has asked regarding our home modification. We hear the same thing and we fax the same information over and over again. I just want to know one way or the other. The latest letter said we would know something in 20 days, same as the last few letters we received! I wish someone could help us!
