Bank of America has a lovely new customer relation system. I'm trying to work through a modification for the second time. They have assigned an individual to work with me, which sounds better than the total chaos that went on last time. Whenever I call in, which was several times a day every day this week, I am required to enter my loan number so that the system can identify me. Once I am identified, I am conveniently connected to my account manager, Louis Hungate.

The only problem with this great new system is that Louis NEVER ANSWERS HIS PHONE!!! EVER!! and he NEVER CALLS BE BACK!! EVER!!

I let Fannie Mae know what's going on over there today. They are the investor for my loan. They're supposed to get back to me. If that doesn't help I'll try HUD and the FHA, maybe the FTC.. whatever. I have nothing better to do. I'm trying to stop foreclosure and save my home and I am not going to put up with this crap.

I got a lawyer to advise me about answering the rule 120 hearing. He thinks the fact that they instructed me to make reduced payments in a mod agreement, accepted those payments for a year right up until they began foreclosure, shows there was an agreement that I honored, and they violated, causing most of the delinquency.

I've been battling with BofA since November 2010. Three different people from BofA told me that they could not help until we were at least one payment behind. I was trying to get help so that we wouldn't get behind. Finally we connected with an another organization that is supposed to be helping us but still having problems. A BofA rep called me early on my day off (my hours had been cut back which is why we had problems.) She said she would call back in an hour. She never called back, but we soon received a letter saying we had denied the remodification. That was finally cleared when my husband got a call while I was at work. He said only that the person needed to talk to me, and that we had someone helping us with the remodification. Again, we got a letter saying we had denied the remodification. Only, the number in the letter that we were to call was a FAX line, not a phone line.
Our auction date was set, we hadn't gotten any reponse from BofA until a woman from the Congressman's office got involved. The date was set over two weeks. I tried to contact the negotiator we were assigned but no response until the day before the auction. It was set over again until Sept. 30. She asked who she was to contact if the offer came through. I told her both me and the company helping us. She said there could be only one. I asked for her email. She said there would be no email correspondence. I finally agreed to have her use me as the contact. She then talked to the other organization saying I had said she could not talk to them. So much manipulation. They want to put us out on the streets.
After my divorce, I sold our rental home and our larger home to get costs down. Our house was only $220,000, and the final loan was $156,000 after refinancing once with BofA. Last appraisal showed the house as $143,000, Zestimate shows it at $129,000. We were not out living beyond our means, the economy destroyed our means.
BofA originally got our loan from Countrywide, so I'm sure they bought the loan at a major discount. We refinanced afterwards with BofA asking for a remodification at that time. We were told we did not qualify. Who qualifies then?

I've been working on a loan modification for two years, first I was told I didn't qualify because I made too much money, then I didn't make enough money, then I didn't have a hardship. After 1,000's of phone calls, faxing 100's of documents 1000's of times, I finally got my loan modified to a 25 year, 2% interest rate for the life of the loan, thanks to the help of NACA. So hang in there and be persistant and fight for your home!

My loan is also with the BofA. I have been working with them for over 2 years trying to get approved for the making home affordable program(what a joke), after faxing 100's of documents and countless hours on the phone, I was getting no where. So, I hired an attorney who said they could help. The American Law Firm of Santa Ana charged me $2,495 and said a refi would be no problem. Well,4 months have passed and now they want to do a audit for another $3,000. Imagine that!! What I have learned in this process is that the banks do not have any authority, it's all up to the investors. Who are they-it's classified. and stay away from the American Law Firm. It's all up to the investors. Who are the investors? Well that's classified.

WHAT MANY PEOPLE DON'T UNDERSTAND is that Bank of America is your LOAN SERVICER which is totally different from the OWNER of your loan. 8 out of 10 mortgages are owned by Fannie Mae or Freddie Mac. Bank of America has to request approval from these GOVERNMENT SPONSORED ENTERPRISES in order to modify your loan. It is these entities denying your request and causing an even longer delay. I've heard that if you have no income, you will not be approved, as Fannie and Freddie would rather have your house than receive nothing at all. Fannie and Freddie also instruct BofA as to when to foreclose, another approval request. Once they do foreclose, the house goes to Fannie or Freddie, not BofA. For loans not owned by Fannie or Freddie, BofA is probably in a better position to assist. Just wanted to share this info to help you all understand that there is more than one enterprise to blame, the government included.

An investigation should be lead on fed-ex, I sent my papers to B of A and they never received it.

My question is, where is the goberment to stop this abuses of those banks against millons of people losing their home.

I have the same problem with B of A.

What is going on with B of A? Left hand doesn't know what the right hand is doing.
My wife and I have been working with a BofA home service specialist for the last eight months on a mod loan for our home. The loan data was on its way to underwriting, but yesterday we received a "not eligible" for the Home Affordable Mod Program letter for not receiving required docs in the time frame required, missing, incomplete documents. All lies! We supplied all docs to the specialist in a timely manner and the specialist know that, but can't do anything, Calling the appeals line, I'm told we would only qualify for this loan for one of three reasons: divorce, natural disaster or death. What are these people smoking?

I was out of work for a year and a half. During that time my wife and I were selling our 401k plans to pay the bills. B of A CALLED US to ask if we needed help. At that time we were current on our bills. A year and a half later they qualified us for a “trial payment” plan. Nothing in the paperwork they sent us described paying the amount back that was less than our normal payment. Immediately foreclosure letters came. They said not to worry, they really do not mean anything. After six months of lower payments we decided to stop paying the lower amount and went back to our normal payments because we figured we could not trust the bank, but now they are saying we owe them $13k (which includes a lot of previously undisclosed fees)!!! It has now been two years and we now are behind on our mortgage. I wish we had never answered the phone when these bastards called!! I went from no job but making due, to having a great job and worried about losing my house. I hate these people. It seems as though they led us into a trap where we are going to lose our home.
