“I just never heard back,” Chavez said. “They just kept giving me the runaround, telling me, ‘You’ll hear something, don’t worry.’ But I never heard from them and I’m in this position now.”
Chavez claims Bank of America told him he should pray or maybe get a second job to pay his mortgage.
He says they even told him they couldn’t help him unless he was behind in his payments.
“I feel like I’m a responsible homeowner and I make my payments on time and I just didn’t want to be late,” Chavez said.

My mother had her mortgage modified last april with Countrywide and have made all the monthy payments since then. We pulled her credit report and BAC Loan has been reporting to the credit agencies that she is behind on her payments- not so. They have not updated her loan information and they are taking her payment each month. What can we do to rectify this situation?
I had the same issue. I contacted the the loss mitigation department of my bank. I relayed the information to them regarding the incorrect credit reporting. They told me they would correct the information. They also sent me a letter in the mail stating that they made a mistake and have reported to the credit agencys the correct information. I still have not checked my credit report, but at least I have a letter to dispute the incorrect report. You shoul do the same, ensure that you get the employee numbers and also write them a letter so that if you have to dispute you have something stating that it is incorrect reporting, in the letter ask for a call back tape it and manuscrpit the tape.
