I just went through this entire case, it clearly states that MERS, Mortgage Electronic Registration System, must always act only as an Agent to an Mortgagee and or Lender. This means MERS, can not sue anyone over non payment and can not claim the right for foreclosure upon any Mortgagor/borrower. This for my present business holds important meaning, while the Mortgage pertains specifically to payment of a loan, the actual rights to usage of the property does not allow the Mortgagee to determine what use of the property, can be used for or to whom can use the property for any purpose. The use of the property and to who that use whatever it may be, is strictly given to that person who owns the property out right, as with an Cash buyer. Where in my Investors, an Cash Investor, holds all rights to determine to what extent the investor uses the property, in our case to Rent it to the previous Mortgagor, as long as no ownership, no equity and no ownership benefit is given to whomever Rents the property, anyone, including the previous Mortgagor may Rent the property, thus, it may be sold to an independant Cash Investor who holds no relationship to the previous Mortgagor (Arms Length) and the previous Mortgagor may Rent the real estate which previously was his Mortgaged Property. We do just that, we find Cash Investors, so you do not have to leave the Real Estate, you can remain in the real estate, no ownership, no equity and no ownership benefit but still you may stay, live in and children do not have to change schools. We also help, if the previous Mortgagor elects to accept our education, to settle debt, credit restore and then assist in qualifying for an New Mortgage to eventually, regain the opportunity to acquire the property back from this Cash Investor. It is a manner of purchasing the previous mortgaged real estate property in the future, while staying in it now. We can assist anyone, in any of the 50 states with this type of action. We also recognized by several Real Estate Attorneys as specific Full Forensic Auditors, which we can discover on your behalf if the Loan Origination was done with Predatory Lending, Mortgage Fraud or any Federal, State, or Local violations or any Real Estate Settlement Procedure Act violations or Truth in Lending Violations which all can help in your quest for leverage in dealing with your bank in suits against your Bank/Mortgagee
