Please feel free to use the attached documents and share the information therein as well as this email to illustrate what Litton Loans and US Bank does to people who seek a modification with them: they foreclose and charge unincurred fees. Make this as public as you like. I intend to.
Some additional information you will find helpful: Until I experienced health problems, had my overtime cut, had a startup business failure and finally had to file bankruptcy, I faithfully paid monthly for *over three years.*
The interest on this loan is almost 12%
I sent Litton the necessary paperwork to request a modification this summer. Even though I sent it in weeks before, according to their representative wth whom I spoke yesterday, they received it in their loss mit department only Sept 1. The rep further told me it would be December before they would even know if I “qualify”. How much do you bet I don’t?
Note the charges on the attached Motion of Relief from Stay. Foreclosure charges: 359.50. For what foreclosure? They can’t even foreclose as they don’t even have relief from stay! How can you charge foreclosure fees for a non-existent foreclosure?? Inspection fees: 125.00. Inspections for what? I authoized no inspections. Perhaps they too are connected with the non-existent foreclosure?
I will take further action as necessary to keep my home.

Yes. I think they are trying to scare you from home so they can have some of their friends move in and have big parties.
These friends are potential customers from foreign countries who would love to buy more crappy loans!

The very fact that you are preparing foreclosure proceedings against me WHILE I AM SUPPOSEDLY BEING CONSIDERED FOR A MODIFICATION tells me you are not dealing with me in good faith.
Charging me fees not even incurred – where do I begin on that?
Your executive team is ignoring me – I told you I am NOT going away.
I am already in contact with many parties interested in what is going on here with your company. The media will love this, as I am sure my state government, which even now is putting in place an ARBITRATION program, so you wil NOT be granted a foreclosure until you come and face me. I want you to come and explain to my face why you refuse to modify my mortgage.
To get my home, you’re going to have to kill me for it. I have dealt in good faith. You have not. I refuse to lose what I worked so hard for.
Oh, by the way, after you foreclose and the media and goverment entities are having a field day with you, Bank of America is going to want about 90k from you. My house might be worth 85k from what I am seeing from estimates online. Even less for the sale you will have to hold.
I hope you enjoy losing a lot money and being a lawsuit target and being on the receiving end of a whole lot of anger, because that’s what’s coming after my death. If it means you all end up next to Bernie Madoff, it will be worth it.

If I don’t get to speak to you again, please understand. This is just plain wrong, and I will not – cannot – just sit and let these miserable pieces of subhuman garbage take my home. Even if it means sacrificing my life in the process. I would gladly give my life defending what is right, and to put so much negative publicity on these creeps that maybe their crimes will finally come to light and justice will be done.
