Months of trial loan modification limbo, then foreclosure

Ben Mayfield believed he had a deal that would save his dream home from foreclosure.

His mortgage servicer, GMAC, slashed his monthly payment about 70 percent last July after he asked for a loan modification. Mayfield, who is 57 and a car salesman, made six months of payments, as agreed, according to bank records he shared with Save Your Home.

Then a shocker: GMAC returned his Feb. 1 payment with a notice that it was foreclosing on the Salisbury log cabin he bought 15 years ago.

    Both MMLN and most certainly Colorado Capital are scam operations. I received a letter from MMLN admitting that they have legal issues with Colorado Capital, more specifically a David Castillo,(this man is a real con man, and at one time even had the nerve to get nasty with me on phone when I asked to be kept in the loop on every step of modification). he took our $3000 back in Dec 2008 when MMLN referered our file to them, and litterally did nothing for us. We couldn’t get call backs to voice mails, emails, etc. This went on from Jan 2009 and as of today March 2010 we have received nothing in the way of a mortgage modifcation. We had a signed contract with Colorado Capital, but MMLN, says they are working on trying to get their clients money back, which I seriouly doubt they are, as we have not seen a dime, nor has MMLN offered to refund our moeny, since they are the ones who referred us to Colorado Capital. We have been forced to hire an attorney to consider bankruptcy in order to save our home. Our feelings are MMLN took our financials and sent it on to Colorado Capital, and one of their employess took our credit card number (shame on us for trusting them) and then sent it on to Colorado Capital, who actually charged it to our account before they ever even contacted us.

    These people are criminals and have taken advantage of people who are desparate and in need of help. As far as we’re concerned, so are the mortgage companies themselves. They are not working our mods, they drag their feet. We tried working with them on our own, to no avail. No one at these mortgage companies knows what their doing and they don’t care if you’re desparate. We kept sending docs over and over at their request, but as of 14 months from day we filed for help we have received nothing.

    Only recourse is to file a complaint with BBB and also the Division of Mortgage Lending in your state and also in state that modification company professes to be based in. Nothing will probably come of it, but it’s worth filing a complaint anyway. You will get some feeling of retribution just filing a complaint.

    I am going through the same thing with MMLN and Colorado Capital, specifically Dave Castillo. I have filed claims with the BBB in Denver and I have also filed a claim with the Colorado Attorney General. If you get this email you should do the same. If enough people filed with the Attorney General, a serious lawsuit could result. Good luck.

    My husband and I were taken advantage of by David Castillo and his associate Mike Dellere. We sent a cashier check and the rest we paid with a credit cared and never heard from them again. We have asked for our refund but to no avail. I hope the authorities catch up to them so that other desparate people are not taken advantage of.

    Hey Martin and Doreen,

    I hope you guys get this message. Unfortunately getting your cashiers check back will be difficult. However, contact your credit card company and file a chargeback for the amount CCIG charged you. This is what I did and it worked! The credit card company (Chase in my case) will initiate a claim against the merchant and fight it on your behalf. If the merchant chooses to contest it, they can. BUT, if the merchant fights it and LOSES, then not only do they have to give you your money back, but they also have to pay legal fees to Chase! Who would have thought credit cards could actually do some good ;)
