The Fifth Judicial Circuit has formally adopted a mediation program meant to address the large number of foreclosure cases flooding the court docket.
In effect since July 1, the order signed by Chief Judge Daniel B. Merritt, Sr. requires that all homestead residential mortgage foreclosure cases be automatically referred to managed mediation to open up communication between plaintiff and borrower.
This order comes seven months after the Florida Supreme Court directed each circuit to adopt such a program to ease the number of foreclosure cases on overburdened state courts’ dockets and save judicial resources.
Here in Marion County, which saw a slight decrease in the number of foreclosure filings from July 2009 to June 2010 compared with the year before, mediation will be handled by Tampa-based Oasis Alliance Corporation, which on its website, describes itself as a non-profit organization consisting of a team of Florida Supreme Court-certified mediation professionals.
