Just found out that I have a sale date on my house!!!!! I have been through the Bank of America modification program for a year now, and was not behind on my mortgage until this process took this long. I knew when starting this process that because my husband lost his job it was a good program to get into and the process should only take about 4 months. Well that was a joke. Because it took so long I am now behind on my loan and was not told that I could go into forcloseur by paying this modified portion of my loan. I need some advice for a first time home owner that would do anything to keep our house for my daughter. Please Help!!!!! Oh and I do have all the paper work from when o started this.
Thanks Devon

Hello,
I am trying to help out my brother. He received the summons for foreclosure after trying to have a shortsale which also fell through. His co-signor, who is also my sister, might be willing to co-sign for a loan modification. Please help if applying for a loan modification is still feasible.

With the recent # of "attorney" loan mod companies going down and scamming thousands of homeowners out of their money (with no loan modification results) I decided to search and see if there is a REAL company in the loan mod industry that provides safety, security, economy and results. After sifting through countless "attorney based" (read forensic loan audit scamsters) websites, lead generator (to sell your info to the scamsters) websites and other bogus "loan modification" outfits-I found ONE and only ONE that seems legit and able to offer safety, security, economy and results. This company PMC (for principal mitigation corporation) has the only process of it's kind in the entire nation. Moe should check them out.

I've been reading a lot of information on Matt Weidner's Law blog on fighting foreclosure, loan modifications, etc. I've been researching as much as possible on foreclosure and the best financial moves to make during these trying times. Between both your website and Matt Weidner's blog, I have found a lot of answers. Thank you so much.

An answer to all of these questions is you need to contact HUD in your area and get an appointment with a housing counselor in your area. We were referred to a counselor and she has been great as an intermediary with the bank. You should not seek bankruptcy because they will ask you if you are or ever have filed for bankruptcy but you always need to consult a competent attorney. Always remember that even though you may feel that you cannot afford an attorney the truth is that you cannot really afford not to have an attorney. Our attorney saw that our house was under water and referred us to a HUD counselor. He did seek any fees for modification because he knows it can be iffy. We are in temporary modification and always in contact with a competent representative of the bank. We are hoping for the best.

The bank offered us a repayment plan instead of a loan mod, apparently we have to much extra income? The issue is that we are now 7 months behind. The bank wants our regular payment plus an extra $860.00 every month for 1 year to bring the account current. The payment would be just under $2000.00 every month. Can we still try and negotiate with the bank to put half of the missed mortgage payments at the end of the loan? We don't want to agree to something that might bite us later.
