“San Diego will become ground zero for mortgage fraud litigation,” a very happy Michael Aguirre, San Diego’s city attorney, said Wednesday.

San Diego, CA— All lawsuits filed across the nation against Countrywide Financial Corporation alleging
predatory lending practices were ordered today to be consolidated and heard in San Diego in the Southern Federal District Court. Lawsuits have been brought by the San Diego City Attorney’s Office, and Attorneys General of California, Florida, West Virginia, Connecticut, Illinois and Indiana.

The decision was announced today by the Federal Judicial Panel on Multidistrict Litigation (MDL) after a September 25, 2008 hearing in Boston to determine the appropriate venue for the Countrywide litigation. Read the rest of this entry »

The Year of Foreclosure Prevention Flops

Looking back over the last year, I can’t help but notice the ridiculous amount of clever names used by our government and other consumer advocates in relation to homeowner foreclosure assistance and relief.

The latest Hope for Homeowners program has met little fan fare on this blog because quite frankly, I feel it is just the same ole BS help that makes it only voluntary for lenders and servicers to cooperate and help struggling homeowners.

FHA will continue to offer lenders an alternative to foreclosing on borrowers. Similar to FHA Secure’s recent expansion, lenders will be encouraged to write-down the outstanding mortgage principal balances to 90 percent of the new value of the property. In many cases, reductions in principle will cost lenders less than the losses associated with foreclosure.

BofA CEO Lewis On Mortgage Business And Countrywide

Kenneth Lewis He is speaking to a packed house at a Town Hall Los Angeles luncheon, and I will update later with video clips and Q&A. But here are highlights from an advanced copy of the speech.

Lewis says BofA wants to help struggling homeowners stay in there homes, but admits he can’t help everyone.

“The first step is to review how we got here,” the CEO says in prepared remarks. “There were a lot of factors that played a role. Think of it as a ‘perfect financial storm.’”

Governor Arnold Schwarzenegger today signed SB 1137 by Senate President pro Tem Don Perata (D-Oakland) which requires lenders to contact homeowners and explore restructuring options before initiating the foreclosure process. It will also provide tenants with double the amount of time now afforded to them to move from a foreclosed property and prevent California’s neighborhoods from becoming rundown by requiring owners to maintain foreclosed properties. Countrywide Sued for Predatory Servicing by US Trustee

It is about time that these lawsuits start to hit our court system. I am not a big fan of court and everyone suing each other. But what needs to be done, needs to be done and it’s all for the better. Especially against these mortgage servicing companies that are abusing homeowners and charging bogus fees.

Attention servicing companies: Stop kicking homeowners/people when they are down, because you are being watched and you will pay for the predatory absuses that you are engaged in. Sooner, rather than later.

Countrywide Loves Foreclosing on Homes in California

 Another disturbing fact from the Countrywide school of subprime horrors. One that I have not seen in the media and hopefully this will get some attention.
 
I just ran the most recent stats on REO properties in the Countrywide portfolio as of 10/24/2007. I was astounded by the fact that Countrywide has a HUGE number of homes they have foreclosed on in the state of California. A whopping 3,435 homes to be exact. More than double the amount in Michigan which came in second on the list with a total of 1,611. Florida came in third with 825 Countrywide foreclosed homes and the state of Vermont came in last with only 1 property on the list.

When I look at these numbers it is obvious that Countrywide made a majority of their toxic loans in California and it is also the preferred state where they Mr. Mozilo would purchase servicing rights to these toxic loan contracts.

Was this part of the scheme? My guess is that this is no coincidence at all.

These numbers are based on the shear greed of Countrywide and point out that they targeted the golden state of California with these toxic loans for many years. Originating thousands and thousands of subprime mortgages on high priced properties and collecting HUGE origination and servicing fees on these loans.

You make a lot more cash in origination fees on a $500,000 home in Cali then you do on a $50,000 home in Arkansas. It wasn’t that the great people in Arkansas didn’t need loans because they most definitely did. However, they were the low hanging fruit and didn’t feed the greed of the Countrywide machine.

I would say that the average commission on an a subprime loans was approximately 3%. Usually a loan officer would charge 1% point origination fees and receive another 2% in the form of rebate. 3% on $500k= $15,000 vs. 3% on $50k = $1,500. That’s a $13,500 difference and I GUARANTEE that is why Countrywide made more loans here in California than anywhere in the country.

 These fees continue as these borrowers become delinquent on their loan and their collection departments squeeze big fees from strapped borrowers. Again, there are a lot more delinquent fees to be collected on a $500,000 loan than a $50k loan. A LOT!

I would also say it is safe to say that you have a better chance of getting a loan modification with Countrywide in any other state but California.

Countrywide Hope Department Blues

I would say that 90% of the calls and emails that I receive are from people that are having trouble in dealing with Countrywide’s HOPE Department. All I can say is that I understand exactly where they are coming from. If you need a loan modification, then be ready for a merry go round ride.

Countrywide is the largest home loan lender in the country and they were on of the largest originators of subprime mortgages over the last few years. So, naturally they will have the most delinquent borrowers and defaulting borrowers to handle. The problem is that they are not set up to be a loss mitigation company. They are set up to originate loans. They will probably go from bering the biggest lender to the biggest loss mitigation company. They simply can’t handle the volume that is coming in with the systems they have in place.

Just be prepared to get the run around and be patient when dealing with them.

The phone number to the Countrywide Hope Department is 800-262-4218. You will need to have your loan number ready and be prepared to deal with a professional who is trained to get the most amount of money they can from you and to help you avoid foreclosure.

I just warn my readers not to agree to a deal that you cannot or will be to hard to make. Meaning a large payment to get caught up and then loan terms that you still cannot afford. Just because they agree to modify your loan does not mean it’s a good deal or you should jump on it. So please be leery but also be aggressive in working things out with them.

When dealing with Countrywide’s Workout Department, be cautious and be very proactive. Don’t wait for them to return calls because they have many cases like yours and many of these employees are over worked and under paid.

If you are looking for Countrywide’s Workout Department, then you have landed on the right website. The name of that division is called the HOPE Department and they handle all loan workout’s and loan modifications for people facing foreclosure.

That phone number is 800-262-4218. You will need to have your loan number ready and be prepared to deal with a professional who is trained to get the most amount of money they can from you and to help you avoid foreclosure. I just warn my readers not to agree to a deal that you cannot or will be to hard to make. Meaning a large payment to get caught up and then loan terms that you still cannot afford. Just because they agree to modify your loan does not mean it’s a good deal or you should jump on it. So please be leery but also be aggressive in working things out with them.

This is the single biggest mistake I see my clients get into when dealing with their lender’s loss mitigation departments.

People are usually so happy that their bank will work with them that they forget to make sure that the deal they have on the plate is worth taking on. Don’t forget that this is the same bank that got you into this mess in the first place. I’m not here to bash Countrywide or any other lender. But I am not going to deny the fact that they contributed to the mess we have now and the foreclosure rate that is the highest since the great depression.

Countrywide Foreclosure

If you are a borrower that is facing a Countrywide Foreclosure, there is help for you. You can try calling the loss mitigation and home retention department, its’ called Countrywide’s HOPE. They will work with borrowers that have had financial hardships or their ARM has adjusted and they can no longer afford the payments.

The best thing to do is call them at 800-262-4218. Be ready with your loan number. They will ask you to fax them a hardship letter explaining your circumstances and also proof of finance to back up your claims in the letter.

If you have any difficulties in dealing with them then I recommend seeking help from a certified HUD Housing Counseling Agency or a for profit firm that specialize in representing people and helping them stop foreclosure.

Don’t wait till your further behind and be proactive now. You can save your home!

Stop Foreclosure With Countrywide

I’m going to see what Countrywide is doing to help stop foreclosure and save their clients home.

The number I have is 888-453-3102. I just called it right now and it goes to the customer service announcement. It’s all automated and I just despise these machines. It takes about 3 minutes of saying no and pressing 2 to get to some music and to be placed on hold. As I am on hold there is music and commercials promoting the refinance programs. It’s been 5 minutes, still waiting.

OK, a nice gal just connected me to the HOPE Department which handles loan workouts. She said they have a direct line and that is 800-262-4218. Now I’m on hold again but the music is more mellow and soothing. No commercials. I’m assuming that this is done for a reason because they are dealing with people that are stressed and facing foreclosure. Wait time was about 3 minutes or so.

A nice lady answers the phone and I explain that I am looking for information to help people stop foreclosure and what information she can give me. She explains that she can’t give out information. I ask for a website or any literature and there is none. She just instructed me that if people need help to call the toll free number at 800–262-4218 and if I represent people in helping them then I need to fax a consent for to their fax number at 805-520-5019.

Hopefully I can get more information from them and if anyone has anything they want to share to help others in dealing with Countrywide’s HOPE Department then please comment here.
